JAMES RODDY Last will and testament Blount County Tennessee 1823
In the name of God Amen. I JAMES RODDY of the County of Blount and state of Tennessee being weak of body but sound of mind and knowing that it is appointed for all men to die and wishing to dispose of what worldly things it has pleased the Lord to bless me with do make and ordain this to be my last will and testament. Item; I give and bequeath to my two loving sons, Gideon B. Roddy and Robert C. Roddy all my lands and mansion house and mill and whatever else may belong or in anywise appertain to the said land it being the same that I now live on and have lived on for for a number of years excepting the part that I have already conveyed to my son Alexander to be governed by the following conditions: my three daughters, Anna, Patsey and Malinda being yet single women it is my will and request that they live with their two brothers above named and that the profits arising from the cultivation of the land and the profits from the mill be considered as a jointure for the maintenance and support of the above named daughters and sons so long as the girls live single. Furthermore it is my will that my son Robert C. should be sent to school six months and that the expenses of said schooling be a joint expense out of the profits of the mill and land and not to be chargeable to him after he has come of age. Item 2nd; To my son Samuel Roddy I give and bequeath in addition to what I have already give him one good feather bed and furniture, one good milk cow, and his name being omitted in the item 1st I here make mention that it is my will that he be entitled to the same rights and benefits that is reserved to my daughters in item 1st. Item 3; To my daughter Anna I give and bequeath my feather bed and furniture which is the bed she now claims and is considered by the family now to be hers. Item the 4th; Having in the first item mentioned the conveyance of a part of my land to my son Alexander I wish here to explain the reasons of said conveyance to wit: My son Alexander having advanced divers sums of money to me at different times and I wishing to make him compensation for the same will as my love and affection for him I agreed with him to give to him a part of my land and a horse, bridle and saddle which was worth sixty dollars in full compensation of all demands that he had in me or might have at my decease against my Estate. Now if the title already made should not be sufficient for him to hold said land, it is my will that he does hold the same agreeable to the conditional line agreed on between him and me. Item 5th; To my daughter Malinda I give the woman's saddle that was her mothers in her lifetime and to my daughter Patsey, I give the other woman's saddle which I now have. Item 6th; All other property that I may have it be sold on a credit as my executers may think and first paying what debts others may have against my estate the balance as well so my debts that may be due to me may equally divided between my sons Gideon B. and Robert C., my daughter Patsey and Malinda. Item 7th; It is my will and request as my son Robert C. is a minor that his brother Samuel be his guardian. And lastly I do appoint my two friends John Wheeler and Jesse Bartlett my executors to carry into effect this my last will and testament. Signed with my own hand this 9th day of March in the year of our Lord one thousand eight hundred and twenty three.
Signed James Roddy Wit: Jonathan Tharp and John Roddy
