The author (Marty Grant) is not related to Nicholas Hensley as far as can be proven. He did live in the same county (Washington Co., VA) as my ancestor Larkin Hensley (c1761-1806). They may be brothers, if so then I am a 5th Great Grand Nephew of Nicholas Hensley. Special Thanks to Ruthe Muench and Laura Schreibman for information shared on this family. All Washington Co., VA tax list records on this page were transcribed and shared by Laura. Nicholas Hensley was born ca 1766. I base this on his 1840 census age of 70-79 (born ca 1760/70) and his 1810 age of 26-44 (born ca 1765/84). To reconcile the two you get ca 1765/70. Add to that his first tax list entry dated 1788. If he was 21 then, he was born ca 1767 or before. Now you have ca 1765-67. I used 1766 as an average. He was possibly born in Culpeper County, Virginia but I have no evidence of that other than that several of the other Hensleys who moved to Washington Co., VA were born there. I have not been able to determine who Nicholas's parents were. It has been suggested by others (and I concur) that he might be a brother to one or several of the other Hensleys about his age who also settled in Washington County, Virginia. This list includes: Samuel Hensley (1754-1841), Joseph Hensley (1750/60), Robert Hensley (c1759), Larkin Hensley (c1761-1806), Fielding Hensley (c1761-1833) and William Hensley (bef 1761-aft 1810). There is no direct proof that any of them are brothers, but they did all apparently know each other and lived near each other. They are certainly related in some close fashion. See my general commentary on Hensleys of Washington County, Virginia for more information. Nicholas Hensley was not listed on the Washington Co., VA tax lists for 1782 through 1787. That could mean that he wasn't yet living there or that he wasn't old enough to be listed as a taxpayer yet. Nicholas Hensley was listed on the tax lists in Washington County 1788 through 1790. He was not on the land lists during this period.
On 4 Jun 1783 a Treasury Warrant (# 16713) was issued to Nicholas Hensley, and to Robert Preston assignee of Nicholas Hensley, for 50 acres in Washington Co., VA surveyed 23 Sep 1806. The land was on North Fork of Holston River on a spur of Walker's Mountain, corner of Nathaniel Cornett. One might assume from the above record that Nicholas Hensley was already 21 by 1783 (putting his birth at ca 1762 or earlier), but you didn't have to be 21 to receive land, only to sell it. The wording of it makes it look as though Robert Preston actually got the land, not Nicholas. The 1790 census is lost for Virginia, but Nicholas should have been listed in Washington County that year. Nicholas Hensley was listed on the tax lists in Washington County 1791 through 1800. He appeared on the land lists during this period.
On 24 Sep 1793 Nicholas Hensley was paid for his services of 1 month 3 days as a private in the Washington Co., VA militia. (Virginia Calendar of State Papers Vol. 6 p. 687) The 1798 list of Militiamen for Washington Co., VA includes Nicholas Hensley in 2nd Battalion, 70th Regiment. (Clark, Gerald H. The Militia of Washington County, VA Officers 1777-1835 Militia Men 1798-1835. 1979) The 1800 census is lost for Virginia. The 1800 land tax list entry for Nicholas refers to his 30 acres as "from Lewis Pitts" so I assume that means he bought it from Mr. Pitts. I don't have a deed for that. Nicholas Hensley was listed on the tax lists in Washington County 1801 through 1809.
The 1804 list of Militiamen for Washington Co., VA includes Nicholas Hensley in 2nd Battalion, 105th Regiment. (Clark, Gerald H. The Militia of Washington County, VA Officers 1777-1835 Militia Men 1798-1835. 1979) On 18 Dec 1806 Nicholas Hensley was recommended as a Lieutenant in the Washington Co., VA militia, 2nd Battalion, 105th Regiment in the place of Simon Hensley who refused to accept the position. (Clark, Gerald H. The Militia of Washington County, VA Officers 1777-1835 Militia Men 1798-1835. 1979) On 18 Jul 1809 Nicholas Hensley was replaced as Lieutenant by James Jett in the Washington Co., VA militia because he "failed for eight months to perform the duties of his office." (Clark, Gerald H. The Militia of Washington County, VA Officers 1777-1835 Militia Men 1798-1835. 1979) On 12 Sep 1809, Nicholas Hensley and Robert Preston, his assignee, were granted 50 acres in Washington Co., VA on the North fork of Holston River. Based on Treasury Warrant # 16713. (Land Office Grants No. 60, 1809-1810, p. 50 (Reel 126)). On 16 Jan 1810 Nicholas Hensley sold land to George Goff. It was described as on the Kentucky road near the three springs bordering Alexander McDonald's land, granted to Nicholas 19 Jun 1797. Nicholas signed the deed. No wife signed or was mentioned. (Washington Co., VA Deed Book 4 page 267) On the same date (16 Jan 1810) Nicholas Hensley sold land on Steele Creek to John Ringley. (Washington Co., VA Deed Book 4 page 268) On the same date (16 Jan 1810) Nicholas Hensley sold 55 acres to John Malone. (Washington Co., VA Deed Book 4 page 269) No date was given, but probably same as above, Nicholas Hensley and Lewis Pitts sold land to Jacob Goodman, waters of Steel Creek branch of Beaver. (Washington Co., VA Deed Book 4 page 271) On 16 Jan 1810 Robert Preston sold land to Nicholas Hensley. (Washington Co., VA Deed Book 4 page 317) On 18 Jan 1810 Nicholas Hensley and Robert Preston sold land to George Whisenand. (Washington Co., VA Deed Book 4 page 315) Nicholas did not appear on the 1810 or later tax lists in Washington Co., VA. This is because he had moved to Woodford Co., KY by then. Nicholas Hensley was listed on the 1810 census in Woodford Co., KY. He was the only Hensley listed there that year. The age of his apparent wife was too young to be the mother of all his children, so that is either a census error or the first Mrs. Hensley had died and he had remarried by this time. In fact, no Hensleys were found in Woodford Co., KY that year though they should have been.
