Edward Stuart (1755/58-aft 1834) of Virginia (Henry) and North Carolina (Surry, Buncombe) and South Carolina (Greenville)

I am not related to Edward Stuart as far as I can prove. However, he lived in Buncombe Co., NC at the same time as my own ancestor John Stewart (1730/40-1830). I don’t think they were associated in any way though.


Edward Stuart (also Stewart) was born ca 1755/1758. I base that upon several things:

           1779 tax list, assuming at least 21, thus born before 1758.

           1786 State Census, age 21 and up, thus born before 1765.

           1790 census, age 16+, before 1774

           1800 census, age 26-44, born ca 1755/74.

           1810 census, aged 45+, born before 1765.

           1820 census, aged 45+, born before 1775.

           1830 census, aged 70-79, born 1750/1760.


All of the above age references can be reconciled to a birth of ca 1755/1758. If we ignore the 1779 tax list, in case it isn’t him, then we can say he was born ca 1755/1760.


I don’t know who his parents were, though it seems very likely he’s part of the same family as Nathaniel Stewart (d 1824). I can’t say how Edward ties in though, but I’m certain he does. It depends on how old Nathaniel actually was. He might be old enough to be Edward’s father, but if not, then they are likely brothers.


John Stewart (d 1807) and Rachel had proven sons named Nathaniel and Edward. Was it this Edward? I've seen different claims on to which Edward it was. It could be this Edward, or perhaps another one. This Edward (1755/58) seems too old to be a son of John and Rachel, as their other known children were born in the 1770s, but that doesn't automatically exclude him.


The 1779 Henry Co., VA Tax list shows an Edward Stewart, possibly this same Edward, but I don’t know that for sure. It could easily be someone else.


Edward married someone before ca 1785, presumably in Surry Co., NC. I’ve seen others list his wife’s name as Mary, but I don’t know what the evidence is for that. I’ve also seen her listed as Nancy. I’ve seen no evidence for that either.


Edward is listed on the 1786 State census of North Carolina in Surry Co., NC. He was listed very near several other Stewarts, including Charles 2 houses away, Nathaniel 3 houses away and a John Stewart 2 houses away. Edward's neighbors on either side were Mosses Bledso (Moses Bledsoe) and Denes Laffoon.

Edward was still in Surry for the 1790 census. He was in a section that was alphabetical (roughly) so I can't determine who his neighbors were. The only Stewart listed nearby was a John Stewart, probably the same one near him in 1786.

Many of his kin left Greenville for Buncombe Co., NC before 1810, but Edward remained in South Carolina a little longer. By the 1810 census another Edward had moved to Greenville which of course could cause confusion for researchers. Of the two, this Edward is the oldest.

Edward Stuart joined his relatives in Buncombe Co., NC between 1810 and 1814 and settled on Avery Creek near Jacob, Nathaniel Sr and other family members.


On 9 Feb 1814, Edward Steward purchased 200 acres from Jacob Steward on Avery Creek, south side of Brittains Mountain. Witnesses were Edwards son-in-law William Prator and his son Jacob Steward. (Buncombe Co, NC Deed Book G page 293).


On 1 Mar 1817, Nathaniel Steward (don't know if Jr or Sr) sold 200 acres to Edward Steward Sr. The land was on the West side of French Broad River on Avery Creek, originally granted to Nathaniel Steward 2 Oct 1812. (Buncombe Co, NC Deed Book 11 page 476).


He was referred to as “Sr” because Edward Stuart (c1782) had come of age and was in the same area. The younger Edward was likely his nephew.


On 3 Mar 1817, Nathaniel Steward sold Edward Steward 450 acres on West Side of French Broad River, adjoining Evans, George Penland and Jacob Steward. Witnesses were Jacob B. Steward (Edward's son) and Charles Steward. (Buncombe Co, NC Deed Book 11 page 434).


On 1 Aug 1817, Nathaniel Stewart Jr (c1772) sold Edward Stewart Sr 150 acres on the West Side of French Broad River. Witnesses were Jacob Stewart and Charles Steward. (Buncombe Co, NC Deed Book 11 page 431).


On 5 Dec 1818, Edward Stewart received a State Land Grant for 100 acres on Avery Creek. This record could be for the younger Edward, though I can't tell for sure. (Buncombe Co, NC Deed Book 13 page 59).


Edward Stuart was listed on the 1820 census in Buncombe. He was listed next door to Nathaniel Stuart (Sr). His neighbor on the other side was Robert Rogers. Edward’s son-in-law William Praytor was just 3 houses away.

On 19 Dec 1821, Edward Stuart received a Land Grant for 100 acres on Bent Creek (this was the next creek up the French Broad from Avery Creek, so just over the ridge from where he lived). This same land Grant was recorded twice in the deed books for some reason (as were many grants). (Buncombe Co, NC Deed Book 13 page 29 and Book 97 page 21).


On some date in 1821, Edward Stewart sold 100 acres on Avery Creek to Jacob Stewart. I'm not sure if this was his son Jacob B. Stewart or the older Jacob. (Buncombe Co, NC Deed Book 13 page 75).


In October Court, 1824, in Buncombe County, Edward Stuart was granted letters of Administration for Nathaniel Stuart (Sr), who was either his brother or father. Charles Stuart was his security.


Edward Stewart Sr was listed on the 1830 census in Buncombe County. He was clearly on his Avery Creek land, based on some neighbors of his, including my ancestor Jeffrey Grimes (Graham), who was just three houses away. Edward’s next door neighbors were Joshua Jones Sr and my uncle Charles Moore. No other Stewarts were nearby, apparently. (Neither the Moore nor Graham/Grimes are related to the Stewarts as far as I’m aware.)

On 1 Oct 1834 Edward Stuart sold 31 acres on Avery Creek to William H. Fulton. (Buncombe Co, NC Deed Book 21 page 7).


The above deed (1 Oct 1834) is the last record I found for Edward Stuart. He died sometime after that (assuming that was him at all, and not the younger Edward).


In 1835, Congressional Elections were held in Western North Carolina, and many of the Stewarts were listed as voters, however, There was an Edward Stewart listed as a voter in Bent Creek Precinct (which included the Avery Creek area). I don't know if this was this Edward, or Edward (1782) who also lived in that area.


I didn't find Edward on the 1840 census, nor any apparent widow. Their son Jacob was in Haywood Co., NC in 1840. They had no extra people in their house that could be Edward, Mrs. Stewart, or sister Polly. Son-in-law Joshua Jones was in Henderson Co., NC in 1840, and likewise, he had no extra people in household that could be his in-laws. The same was true for son-in-law William Praytor, in Buncombe in 1840. No extra people.


We know for sure that Polly (c1785) was still alive, so where was she in 1840? She could have been with any of her siblings and they simply forgot to report her to the census taker.





Children


Edward Stuart and wife had four children per the 1786 through 1830 census records. An 1847 deed proves who they are when three of the heirs deeded some of their share of Edward’s estate to Polly Stuart, their unmarried sister:


On – Nov 1847, J. B. Stuart of Cherokee Co., NC, William Prator of Buncombe Co., NC and Joshua Jones of Henderson Co., NC, heirs at law of Edward Stuart, deceased, deeded land to Polly Stuart of Henderson Co., NC. (Buncombe Co., NC Deed Book 24, p. 225.)


While the deed above does not explicitly say that Polly is also an heir, I think it is implied. The deed also does not state they are the only heirs of Edward, but I believe census analysis supports the notion that they are the only heirs. If Edward and wife had other children they probably died young.

2.         Nancy Stuart (c1788-1850s) married William Praytor.

3.         Jacob B. Stuart (c1794-aft 1850) married Mary —.

4.         Susanna Stuart (c1799-1850/55) married Joshua Jones.





Mary “Polly” Stuart was born ca 1784/85 per her age on the 1850 census (65). She was born in North Carolina, likely Surry County.


She apparently never married.


She seems to be home with her parents for the 1786 census (no ages given) and 1790 (no ages given). She was with them in 1800 (age 16-25, born ca 1774/84), and 1810 (age 16-25, born ca 1784/94), and in 1820 (age 26-44 (1775/94), and 1830 (age 30-39, born ca 1790/1800).


I did not find her in 1840, she was probably residing with another family, but she did not appear to be with any of her siblings.


On -- Nov 1847, Polly Stuart of Henderson Co., NC purchased land from her siblings in Henderson Co, NC, being inherited from Edward Stuart deceased. The deed was from J. B. Stuart of Cherokee Co, NC (her brother), William Prator of Buncombe (her brother-in-law), and Joshua Jones of Henderson (her brother-in-law). The deed states that they are heirs at law of Edward Stuart, Deceased. (Buncombe Co, NC Deed Book 24 page 225).


She is listed on the 1850 census in Henderson Co., NC with Joshua Jones and wife Susanna (her sister). (See their entry below for that record.)


Polly died before the 1860 census. Her estate was dated that same year. The file only contained an inventory and administration bond. No heirs were named.





Nancy Stuart was born ca 1787/88 in NC, probably Surry County.


Nancy was apparently home with her parents for the 1790 census (no ages given). She seems to be with them in 1800 (age 10-15, born ca 1784/90), and 1810 (age 16-25, born ca 1784/94).


Nancy married William Praytor sometime ca 1810 in Buncombe Co., NC.


William was born ca 1789/90 per his age on the 1850 census (60) or ca 1790/91 per his age in 1806 (69) which is a close match. He was born in Laurens Dist., SC per his 1860 census entry. I don’t know who his parents were. There were six Praytor households listed in Laurens in 1790: Joseph, Bazel, Buri, John, John and Mary. All of those, except Buri and Mary, had at least one male under 16, which is the group William would be in if actually born before 1790.


William Prator was listed on the 1820 census in Buncombe Co., NC just three houses from father-in-law Edward Stuart. He was listed between John Carlan and Amus Waldrip.

William Prater was listed on the 1830 census in Buncombe, just two houses from Charles Stuart, between Noah Green and Wiley Crosby.

On -- Nov 1847, William Praytor and the other heirs of Edward Stuart sold their interest in a tract of land to Polly Stuart. The deed was from J. B. Stuart of Cherokee Co, NC, William Prator of Buncombe, and Joshua Jones of Henderson. The deed states that they are heirs at law of Edward Stuart, Deceased. (Buncombe Co, NC Deed Book 24 page 225).


William and family were listed on the 1850 census in Buncombe County. He had some apparent grandchildren mixed in with his children, so I'm not sure which were his, and which were grand kids.

The family moved to Cherokee Co., NC between 1850 and 1860. Brother Jacob B. Stuart had been living there, but was gone by this time.


Nancy Stuart Praytor died sometime between 1850 and 1860. I don’t know if she died before or after the move.


The family is on the 1860 census in Cherokee Co., NC. I didn’t see any known relatives listed nearby.

Clay County was created in 1861 from eastern Cherokee County. That included the area where the Praytors resided.


I didn’t find William Praytor on the 1870 census. There was one who was listed on the 1870 Mortality Schedule in Catoosa Co., GA. William Prater, age 70, died March, born SC, Farmer. That sort of matches, though he’s about ten years too young.


That could certainly be him despite the age difference. There is an administration bond in Clay Co., NC dated 26 Oct 1870 for William Praytor deceased, by Madison Curtis, administrator. Bondsmen were J. S. Anderson and R. S. Pass.


That shows he was definitely dead by Oct 1870. That also means the one who died in March 1870 in Catoosa Co., GA could be the same man if he happened to be down there when he died, as the timing is good for both records to be for the same man.





Jacob B. Stuart was born ca 1793/94 per his age on the 1850 census (56). He was born in North Carolina per the same source, likely in Surry County.


He was probably named for the older Jacob Stuart (1777), an uncle perhaps. I don’t know what his “B” initial stands for. Perhaps that’s a clue to his mother’s maiden name? Or not.


Jacob seems to be with his parents in 1800 aged under 10 (c1790/1800) and with them in 1810 aged 16-25 (1784/1794) and home in 1820 age 26-44 (1775/1794).


Jacob B. Stuart married Mary — before ca 1825 in Buncombe Co., NC. She was born ca 1809/10 per her age on the 1850 census (40). She was born in North Carolina per the same source, perhaps in Buncombe County. I don’t know her maiden name.


They are listed on the 1830 census in Buncombe next to the older Jacob.

Jacob moved to Cherokee Co., NC before 1847, for that’s where he was living when he made the 1847 deed with his siblings. However, he didn’t remain there long. He was in Cass Co., GA by the time of the 1850 census.

I was unable to find Jacob or Mary on the 1860 census. I checked 1870 also with no luck. They may have both died in the 1850s.

Susanna Stuart was born ca 1798/99 per her age on the 1850 census (51). She was born in South Carolina per the same source, likely Greenville District.


Susanna was apparently home with her parents for the 1800 census (age under 10, born ca 1790/1800), and 1810 (age 10-15, born ca 1794/1800). She was not home in 1820, so apparently married by then.


She married Joshua Jones in Buncombe Co., NC before 1820. Joshua was born ca 1794/95 in NC.


Joshua Jones was listed on the 1820 census in Buncombe Co, NC. He was listed between Benjamin Hawkins and Charles Moore. Joshua had 11 slaves in 1820.

In 1830, there were three Joshua Jones’s listed in Buncombe. I believe I’ve identified the correct one. He is between William Jones and James Long.

In 1838, Henderson County was formed from the southern part of Buncombe County, including McDowell Creek, where the Jones family resided.


Joshua Jones was listed on the 1840 census in Henderson Co., NC. They were just a few houses from Isam P. Stuart (cousin). They were between James Ballard Jr and George Killiam.

On -- Nov 1847, Joshua Jones and the other heirs of Edward Stuart sold their interest in a tract of land to Polly Stuart. The deed was from J. B. Stuart of Cherokee Co, NC, William Prator of Buncombe, and Joshua Jones of Henderson. The deed states that they are heirs at law of Edward Stuart, Deceased. (Buncombe Co, NC Deed Book 24 page 225).


Joshua and family were listed on the 1850 census in Henderson County. Susanna’s sister Mary Stuart was residing with them.

Unfortunately, their entry was at the bottom of the page and should continue onto the next page. However, the 1850 Henderson Co., NC census doesn’t work that way. At some point in history the pages got all out of order. Instead of putting them back in the right order, someone simply renumbered all the families, thus the family at the top of the next page that seems to be a continuation of this one, isn’t. Going by the 1860 census entry for the Fannings, we see they had two additional children who should have been listed with them in 1850, Susan (c1847 NC) and Emma (c1849 TN). I didn’t find those two listed at the top of another page, but I could have missed them. In addition to the pages being out of order on the 1850 census for Henderson, it does seem some pages are also missing.


Susanna Stuart Jones died sometime between 1850 and 1855 in Henderson Co., NC.


On 26 Jul 1855, Joshua Jones married Amanda Evaline Stuart, who was Susanna’s cousin. She was a child of Isam P. Stuart and Serenia T. Ray. Isam was probably a son of Charles Stuart (1770/75).


They are on the 1850 census in Hendersonville (town). Amanda’s sister Mary is residing with them.

Joshua Jones made his Will in Henderson Co., NC on 19 Jun 1872. It was proven in court 2 Nov 1873 meaning he was dead by then.


He named:

           Wife M. E. Jones

           The four children he had by her:

                        Magnetta M. Jones, Michel W. Jones, Lidda S. Jones and Pinkney N. Jones

           The four children by his first wife:

                        Rutha L. Fanning, Manerva M. Thoms, Lucinda E. McDowell, Ruemma A. Allen

He named Melvin M. Steward and F. M. Fanning as his executors.

He signed the Will. Witnesses were A. J. Stone and J. M. Ballard.
