I am not related to James Stewart as far as I can tell. However, he lived in Cherokee Co., NC where several of my own Stewart kin lived, their time there overlapping. Namely my uncle Jacob Stewart (c1774-1863) who was there in the 1840s; my cousin Stacy Stewart Moss Colvard (c1815-aft 1880), and my other uncle Jacob Stewart (c1822-1881) who was there in the 1850s and 1860s.
James Stewart was born 15 Dec 1795 per his tombstone. This works with his age in 1850 (54), but not quite in 1860 where he’s 62, or born ca 1797/98. He was born in Wilkes Co., NC per his 1860 census entry.
I’ve seen no actual proof yet, but it seems that James is a son of an elder James Stewart (1765/70-aft 1840) and his second wife Elizabeth Brown (married 1793 in Wilkes). This works circumstantially age-wise and location-wise.
James would have been around 4 years old at the 1800 census. James (Sr) was the only Stewart in Wilkes in 1800 and he had three apparent sons under age 10, (born ca 1790/1800) one of whom is likely James (1795).
James would have been around 14 for the 1810 census. Again, James (Sr) was the only Stewart in Wilkes for that census. He had one apparent son aged 10-15 (born ca 1794/1800) and one aged 16-25 (ca 1784/1794), the younger of which is likely James (1795).
James would have been 24 for the 1820 census, old enough to be on his own. However, I believe he was still at home with his parents. James (Sr) had two apparent sons at home aged 16-25 (born ca 1794/1804) and one 26-44 (born ca 1775/1794).
James would have been 34 for the 1830 census. He was still unmarried and apparently still with his parents. James (Sr) had a male aged 30-39 (1790/1800) with him, which is probably James (1795).
James would have been 44 for the 1840 census. Though still unmarried, he wasn’t listed as a head of household, nor did he seem to be with his father James (Sr) this time. However, James (Sr) did have two sons aged 30-39 (1800/1810) at home. One of those could be James (1795) if put in the wrong column by mistake.
James Stewart married Harriett Katherine Scott on 28 Nov 1843 in Burke Co., NC. I haven’t found a primary source for this marriage date. I would suspect it’s from a Bible record. Harriett was born 6 Dec 1813 per her tombstone. She was born in Burke Co., NC per her 1860 census entry. Proof of her maiden name can be found on the death certificates of several of her children. Her middle name is given on at least one of those.
I do not know who her parents were. There were eleven Scott households on the 1840 census in Burke Co., NC. She would have been 27 at that time. The households of Joseph Scott (1780/90) and John Scott (1780/90) both had apparent daughters her age. They were listed side by side on the census. It is perhaps noteworthy that Harriett named her oldest son John Stewart. However, her second son was Joseph Stewart, so perhaps we can’t read too much into that, except that perhaps both John Scott and Joseph Scott were closely related to her. Joseph Scott, 76 and John Scott, 70 are near each other on the 1850 census in Burke. Thomas Scott, also 70, is right there with them. Joseph’s wife was Rachel, John’s Nancy, and Thomas was widowed.
James and Harriett Scott Stewart moved into Caldwell Co., NC shortly after marriage. (Caldwell was formed in 1841 from parts of Wilkes and Burke.) Their two oldest children were born there in 1844 and 1845 per their 1860 census entries.
They were in Cherokee Co., NC by 1847 and remained there. They settled in what became known as Valleytown Township not far from the present town of Andrews.
They are on the 1850 census in Cherokee Co., NC. They are also on the slave census as they were slave owners. James’s parents had been as well.
