Records for John Stewart in early Mecklenburg County, North Carolina
[Stewart Home] - [Table of Contents] - John Stewart Records in Mecklenburg
There were several men named John Stewart or Stuart in Mecklenburg County early on. This page is my attempt to sort them out by determining which record belongs to which John.
The known John Stewarts:
∙ John Stewart (c1729-aft 1771) m. Susannah Fulkerson Bledsoe. Resided NC (Rowan (later Surry), Mecklenburg), later to TN. In Mecklenburg ca 1771-1775.
∙ John Stewart (1730/40-1830) and wife Mary of NC (Mecklenburg, Cabarrus, Buncombe, Haywood, Macon). This is my ancestor.
∙ John Stewart (bef 1755-aft 1816). Son of Alexander and Elizabeth. Wife unknown. Had land on Fourmile Creek. Last know alive in 1816, perhaps 1820. Had proven son named Alexander.
∙ John Stewart married Catherine Allen between 1778 and 1790.
∙ John Stewart (bef 1765-1826). Son of Matthew and Elizabeth.
∙ John Stewart (bef 1770-aft 1817) and wife Mary Davis of NC (Mecklenburg, Cabarrus). Son of Thomas.
∙ John Stewart (bef 1805-1827) son of John (bef 1765) son of Matthew.
Time-line of the county:
∙ Bladen County formed in 1734, theoretically encompassing what would later become Mecklenburg, though I doubt (m)any whites were in that region yet in the 1730s or early to mid 1740s.
∙ Anson County formed from Bladen in 1750. Encompassed what would later become Mecklenburg.
∙ Mecklenburg County formed from Anson in 1762, effective 1763. At the time included much of upper west South Carolina until the border was properly surveyed in 1773.
∙ Tryon County formed from western Mecklenburg in 1768, effective 1769. Tryon abolished in 1779 becoming Lincoln and Rutherford.
∙ Cabarrus County formed from north eastern Mecklenburg in 1792.
∙ Union County formed from eastern Mecklenburg and western Anson in 1842.
On 30 Nov 1758 (lease) and 5 Dec 1758 (release), John Clark of Anson sold land to John Dickinson of Augusta Co., VA. No acreage listed, but described as on S side Broad R, S Fork of Sandy River including the improvements bought of John Stewart. W: Adam Dickinson, John Larsey, John Butler. (Anson Co., NC Deed Book 5, pp. 76-78)
The land above is in present day Union Co., SC, but would have fell into Mecklenburg after 1763 and before the state lines were figured out in 1773. South Carolina would have considered this Craven County, Saint Mark’s Parish until 1769. I don’t know which John Stewart this might be, but probably not any of those later found in Mecklenburg.
A map showing the waterways in old Mecklenburg where Stewarts had land.
On 25 Nov 1770, John Stewart made a land entry for 300 acres in Mecklenburg on a large branch of the Stony Fork of Mallard Creek. (Land Entry Book 20, p. 687.) The survey was dated 25 Nov 1770. William Grills and William Stewart were chain bearers. The land was granted to him on 18 Apr 1771, Grant Number 243, File Number 1838 (North Carolina Land Grants.)
Notes: This appears to be John Stewart and Susanna Fulkerson Bledsoe formerly of Rowan (now Surry) Co., NC, last seen there in 1769. William Stewart, one of the chain bearers for the survey, is their son who would have been about 14 then. We know which John this is because when he sold the land a few years later his wife Susannah signed the deed also.
On 1 Mar 1775, John Steward of Mecklenburg Co., NC made a deed to William Alexander of Mecklenburg, for £50, 300 acres on the Stony Fork of Mallard Creek. Mentions Irwin’s corner, Clarks’ line. The land was patented to John Steward 18 Apr 1771. The deed was signed by John Steward and Susannah Steward, both of whom made marks. The published version shows both marks as an “S” but I’m not entirely sure that is what the marks are. Could be, but maybe not. William Hemphill and George Reed witnessed. Hemphill proved the deed in April 1780 court. (Mecklenburg Co., NC Deed Book 11, pp. 51-52).
Notes: This appears to be John Stewart and Susanna Fulkerson Bledsoe, the same land entered in 1770, granted in 1771, now sold in 1775. They moved to eastern Tennessee after this, now Sullivan County.
On 7 Sep 1778, James Way sold land to Robert Arthur. It was 227 acres on both sides of Fourmile Creek joining Henry Downs and Thomas Harris. Mentions Harris and Craig’s corner. Signed by James Way. Witnessed by John Stuart and Benjamin (B) Allet. (Mecklenburg Co., NC Deed Book 10, pp. 73-75.)
Notes: This is John Stewart (bef 1755-aft 1816) of Fourmile Creek, son of Alexander Stewart (d 1789).
Notes: Henry Downs and Thomas Harris were associated with Robert Stewart (d 1777) who had no son named John, at least not per his Will.
On 14 Feb 1780, the same 227 acres from the 7 Sep 1778 deed was sold by Robert Arthur and wife Sarah to James Kenedy. The land description was the same. Robert Arthur and Sarah Arthur both signed. Witnesses were John Flenniken and John Stewart. (Mecklenburg Co., NC Deed Book 11, pp. 2-4.)
Notes: This is John Stewart (bef 1755-aft 1816) of Fourmile Creek, son of Alexander Stewart (d 1789).
On 1 Apr 1780, Ezekiel Polk of Mecklenburg made a deed to Samuel Hemphill, also of Mecklenburg. For 500 pounds he sold him Lot 65 in the Town of Charlotte on the south side of Tryon Street, it being ½ acre. Ezekiel Polk signed. Witnesses were John Stuart and Hugh Pollock. John Stuart proved the deed in April 1780 court. (Mecklenburg Co., NC Deed Book 11, pp. 22-23.)
Notes: We know that Matthew Stewart had lots in Charlotte on Tryon Street, and had a son named John, so this is probably that John Stewart (bef 1765-aft 1826).
On 27 Sep 1787 Robert Galbreath entered 100 acres on both sides of Four Mile Creek. Southwest side of David Moore’s place that he now lives on and his own land. Entered by Robert Galbreath, assigned to John Stewart. Near John McCreevan line, David Moore’s corner. Surveyed 10 Oct 1790. Michal Hubbart, Robert Galbreath, CB. Granted 20 Dec 1791, Grant Number 979. (North Carolina Land Grants.)
Notes: This is John Stewart (bef 1755-aft 1816) of Fourmile Creek, son of Alexander Stewart (d 1789).
Notes: The land “he already owned” referenced above probably refers to Robert Galbreath, not John Stewart, since Galbreath was the originally patentee.
On 2 Feb 1790, John Stewart of Mecklenburg made a deed to Abraham Miller, of Mecklenburg, for 100 pounds for 68 acres on south east side of McCalpins Creek, joining his own land. The land was further described as being a patent to John Starr (no date), who died intestate, then fell to Arthur Starr eldest son of John Star, who now has full power to convey the same, as now does John Stewart who conveys it Abraham Miller. The wording of that (not quoted) is a bit confusing. I would normally assume this meant Arthur Starr conveyed it to Stewart who then conveyed it, in this deed, to Abraham Miller, which makes sense. However, I’ve found no deed where Arthur Starr conveys this land to Stewart. Is it suggesting John Stewart is also an heir of John Starr? John Stewart signs the deed. Witnesses are Will Miller, Alexander Stewart and Query Hinds (dim, might say Levicy Hinds). The deed was acknowledged in April 1796 court. (Mecklenburg Co., NC Deed Book 15, p. 170, one of two deeds on same page.)
On 23 Jul 1790, the same two parties made another deed, that is John Stewart to Abraham Miller, this time for 200 pounds for 140 acres on south east side of McAlpins Creek, including John Stewarts improvements, suggesting Stewart had been living on the land. It was further described as being part of a 240 acre tract John Starr purchased from Henry E. McCullogh, then John Starr dying intestate, fell to Arthur Starr. It is worded the same as the prior deed, though once again I found no record of Arthur Starr conveying it to John Stewart. John Stewart signed the deed. The section with the witnesses is mostly illegible but Will Miller’s name can be made out. This deed was also acknowledged in April 1796 court [by John Stewart]. (Mecklenburg Co., NC Deed Book 15, p. 170, second of two deeds on same page.)
Notes: This is John Stewart (bef 1755-aft 1816) of Fourmile Creek, son of Alexander Stewart (d 1789). Fourmile Creek and McAlpine Creek run parallel for several miles before Fourmile joins McAlpine.
Notes: John Starr had sons Arthur, John and Thomas Stewart Starr. That middle name for Thomas is probably not a coincidence.
Notes: As noted above, I found no record of how John Stewart acquired either of these tracts. Did he inherit them via his wife? Was she perhaps a daughter of John Starr?
On 20 Feb 1790, Edward Harris of Iredelle (sic) Co., NC made a deed to Mathew Stuart of Mecklenburg. For L2, he sold him land in the “Western District” (Tennessee), on the waters of the Long Creek, Thomas K. Sharp’s corner, James Rutherford’s corner, being land granted to Harris in 1788. I didn’t see any acreage listed. Ed. Harris signed. Witnesses were Evan Alexander and John Stuart. (Mecklenburg Co., NC Deed Book 13, pp. 865-866.)
Notes: This John Stewart (bef 1765-1826) son of Matthew Stewart.
There were two John Stewarts on the 1790 census in Mecklenburg.
1790 Census Mecklenburg Co., NC
p. 374 John Stuart 1-0-3-0-0 This is John Stewart (bef 1770-aft 1817), son of Thomas Stewart (d 1778).
p. 384 John Stuart 2-3-4-0-0 This is John Stewart (bef 1755-aft 1816) of Fourmile Creek, son of Alexander Stewart (d 1789).
The Mecklenburg Census was alphabetical by companies or districts (untitled).
The first John Stewart listed (p. 374) is in the area that later became Cabarrus County. He was in the same district with Joseph Biggars, William Black, James Crumel (Cromwell), John Crumel (Cromwell), Thomas Davis, John Harris, David McKinley, William Newell, Francis Newell, Samuel Stuart, William Stuart, Widow Stuart, Archibald White and others associated with Thomas Stewart (d 1778) of Mecklenburg/Cabarrus. This means this is most likely John (bef 1770) son of Thomas. Widow Stuart was his mother, Catherine. William was his brother. Samuel might be related, but wasn’t his brother.
John Stewart on page 384 was in the same district with many of the same names we see on the deeds for John Stewart (bef 1755-aft 1820) of Fourmile Creek, son of Alexander (d 1789), so it’s probably that John. Some of those listed were also associated with Robert Stewart (d 1777), suggesting Alexander and Robert could be brothers.
On 2 Sep 1790, Agness Allen made her Will naming her children including a daughter Catherine Stewart. She also forgave John Stewart the debt he owed to her, but didn’t state any relationship to him. He could be Catherine’s husband which would explain his inclusion. Others names were daughter Mary Osborne and her husband James Osborne, daughter Agness, daughter Mildridge Wallace, daughter Agnes Cathey, daughter Martha Cathey, son George Allen, daughter Sarah Allen, son William Sample Allen. Witnesses were Samuel Graham and Hezekiah Alexander. (Mecklenburg Co., NC Will Book A, p. 38 and also Mecklenburg Co., NC Probate Records.)
Notes: This John Stewart is currently unidentified. He would have to be either John (1770-aft 1817) son of Thomas (d 1778), or John (bef 1755-aft 1820), son of Alexander (d 1789).
Notes: Agnes is the widow of John Allen who died in 1778.
Notes: Some have tried to make Catherine Allen Stewart into the same Catherine who was wife of Thomas Stewart (d 1778), but that can’t be for John Allen’s Will of 1778 lists his daughter as Catherine Allen, and this was one month after Thomas Stewart made his Will, meaning they can’t be the same Catherine as John’s daughter wasn’t yet married in 1778.
On 19 May 1791, John Stewart entered 80 acres on Fourmile Creek joining land he bought of Robert Galbreath. Joining James Buchanan, Widow Wily, Gordon Potter. David Stinford, Thos G. Black, CB. Granted 28 Nov 1792, grant number 1505. (North Carolina Land Grants.)
Notes: This is John Stewart (bef 1755-aft 1816) of Fourmile Creek, son of Alexander Stewart (d 1789). With this record, he has 180 total acres on Fourmile Creek.
On 19 Apr 1792, John Stewart entered 70 acres described as on the waters of Waxhaw and Cain Creek adj Alexander Carnes and his own land and the state line. The survey turned up only 68 acres. George White and Daniel Carns were chain bearers. The 68 acres was granted to John Stewart on 9 Jul 1794 (Grant # 1187). (North Carolina Land Grants and Mecklenburg Co., NC Deed Book 14, p. 202.)
Notes: This is John Stewart (bef 1765-1826) son of Matthew Stewart (1720-1808). The entry and grant says the land bordered his own land, but I’ve seen no record of him acquiring any other land on Waxhaw or Cain Creek before then. It could be that his other land was in South Carolina across the line. With this record, John, son of Matthew, has 68 acres total.
On 25 Feb 1793, John Stewart entered 25 acres on waters of Fourmile Creek Joining John McCreevan?, Widow Finney, Polks Land, Wm Young, & his own land. Duncan McCreevan and John McCreevan were chain bearers for the survey (I failed to get survey date.) The land was granted on 9 Jul 1794 (Grant Number 1169). (North Carolina Land Grants.)
Notes: This is John Stewart (bef 1755-aft 1816) of Fourmile Creek, son of Alexander Stewart (d 1789). With this record, he has 205 total acres on Fourmile Creek.
On 25 Feb 1793, John Stewart also entered 125 acres on waters of Fourmile Creek joining Gordon Potter and William Young. The survey was dated 2 Feb 1794 with Duncan McGreevan, John McCreevan as chain bearers. The land was granted on 9 Jul 1794 (Grant Number 1201, North Carolina Land Grants.)
Notes: This is John Stewart (bef 1755-aft 1816) of Fourmile Creek, son of Alexander Stewart (d 1789). With this record, he has 330 total acres on Fourmile Creek.
On 31 Jul 1793, Rebecca Moor, Archibald Walker and Hugh Coffey, heirs of William Moor deceased, made a deed to John Stewart, all of Mecklenburg. Mentions John Stewart’s wife Agnes was willed property. Land on East side of Waxhaw Creek, 100 acres. Another tract on Cain Creek ... John Barnett’s old line ... 93 acres. Combined 193 acres. Signed Rebeckah Moor (her mark), Archibald Walker, Hugh Coffey. Witnesses were William [faded], John Coffey, John Lemond? (Faded). (Mecklenburg Co., NC Deed Book 15, p. 54.)
Notes: This is John Stewart (bef 1765-1826) son of Matthew Stewart (1720-1808). With this record, John, son of Matthew, now has 261 acres on Waxhaw & Caine Creeks.
On 31 Jul 1793, Rebecca Moore, Archibald Walker and John Stewart, being lawful heirs of William Moore, deceased, to Hugh Coffee, 200 acres on Waxhaw Creek. Signed by Rebeckah Moore (her mark), Archibald Walker and John Stewart. Witnessed by William Query and John Coffee. (Mecklenburg Co., NC Deed Book 16, pp. 68-69.)
Notes: This is John Stewart (bef 1765-1826) son of Matthew Stewart (1720-1808). Since this was land inherited from William Moore, I don’t think this transaction reduces the amount of land that John Stewart owned.
On 16 Aug 1793, Andrew Alexander, Esqr, late Sheriff of Mecklenburg, deeded land to John Stewart, Planter, of Mecklenburg. 196 acres C??? creek (indexed as Croatan, but might be Crooked Creek). Mentions the waggon road. Signed by Andrew Alexander. Witnessed by William McCall and Matthew Walker. (Mecklenburg Co., NC Deed Book 15, pp. 51-52.)
Notes: This is John Stewart (bef 1765-1826) son of Matthew Stewart (1720-1808). With this record, John, son of Matthew, now has 457 acres total on Waxhaw, Cain and Crooked Creeks.
On 16 Aug 1793, Andrew Alexander, Sheriff of Mecklenburg, made a deed to Mathew Stewart, planter, of Mecklenburg for 404 acres on Goose Creek in 4 tracts. The Sheriff signed the deed. Witnesses were John Stewart and Wm McCall. (Mecklenburg Co., NC Deed Book 15, p. 73.)
Notes: This is John Stewart (bef 1765-1826) son of Matthew Stewart (1720-1808).
On 17 Jul 1797 John Stewart of Mecklenburg made a deed of gift to Alexander Stewart of Mecklenburg, for love and affection to my son ... both sides of 4 Mile Creek ... David Moor’s corner ... 100 acres. Another tract ... widow Faney’s corner ... William Young’s corner ... 25 acres, combined being 125 acres. Signed John Stewart. Witnessed by Thos Hutson?, Thomas Barber. Proven by the grantor Aug 1816 court. (Mecklenburg Co., NC Deed Book 20, pp. 240-241).
Notes: This is John Stewart (bef 1755-aft 1816) of Fourmile Creek, son of Alexander Stewart (d 1789). With this record, his 330 acres on Fourmile Creek is reduced to 205 acres.
On 1 Jan 1794 Matthew Stewart and his wife Elizabeth Stewart of Mecklenburg, made a deed of gift to their son John Stewart of the same place. Being 45 acres on both sides of Crooked Creek on both sides of the “Waggon Road.” Mathew and Elizabeth signed. Witnesses were John Hall and Danl Neil Hall. (Mecklenburg Co., NC Deed Book 16, p. 138.)
Notes: This is John Stewart (bef 1765-1826) son of Matthew Stewart (1720-1808). With this record, John, son of Matthew, now has 502 acres total on Waxhaw, Cain and Crooked Creeks.
On 23 Jul 1799, John Stewart entered 15 acres on Waxhaw Creek joining Wm Curiton, Samuel Lathen and his own line. Surveyed 15 May 1800, William Stewart and John Stewart, Chain Bearers. (North Carolina Land Grants, Entry # 51.) I didn’t see any record of this actually being granted to John Stewart.
Notes: This is John Stewart (bef 1765-1826) son of Matthew Stewart (1720-1808). William Stewart is John’s brother. With this record, John, son of Matthew, now has 517 acres total on Waxhaw, Cain and Crooked Creeks, assuming this was actually granted to him, otherwise he still only had 502 acres.
There is only one John Stewart listed on the 1800 census in Mecklenburg, which is interesting. There should be more.
1800 Census Mecklenburg Co., NC
p. 604 John Stuart 42001-22110-0-0
It is a bit difficult to determine which John it is. His age and the number of children strongly suggests he’s John (bef 1755-aft 1816) son of Alexander Stewart (d 1789). Furthermore, he is listed next to an Alexander Stewart. John son of Alexander had a proven son also named Alexander. However, his Alexander might not have been old enough to be head of household in 1800. As a counter point, Samuel Black and William McCall are nearby, and those are brothers-in-laws of John son of Matthew Stewart. Archibald Walker is also nearby, and he was an heir to William Moore same as John son of Matthew.
Going by enumerations alone, the entry would have to be Alexander’s son. Going by neighbors, it has to be Matthew’s son. How do we reconcile this? One thing we should consider is that John, son of Matthew, had land bordering South Carolina state line, and he might actually have resided in South Carolina at this point. However, a quick check of the 1800 census for Lancaster Dist., SC (where Waxhaw Creek flowed), shows no John Stewart listed there. There was a John in nearby York Dist., SC, but I have no reason to think that’s John son of Matthew.
On 23 Dec 1800, John Stewart of Mecklenburg made a deed to his son Alexander Stewart for 100? Pounds, on Fourmile Creek, first tract ... James Buchanan’s line ... 80 acres. Second tract ... Gordon Potter’s line ... William Young’s line ... 125 acres, total of 205 acres. Signed by John Stewart. Witnessed by Thomas Huston? And Thomas Barber. John Stewart acknowledged the deed in August 1816 court. (Mecklenburg Co., NC Deed Book 20, pp. 241-242.)
Notes: This is John son of Alexander Stewart (d 1789). With this record, his 205 acres on Fourmile Creek is reduced to zero. As far as I can tell he has no other land on Fourmile Creek at this time and is presumably residing with his son Alexander or other children.
On 26 Nov 1802 land was granted to John Stewart in Land Grant Number 1755, being 30 acres Back Creek. Entered 13 Aug 1801. Joining lines of Jos McGinnis, Daniel Caldwell, and his own. Survey 17 Aug 1801, Wm McKinsie, Joseph McGinnis, CC. (North Carolina Land Grants and Mecklenburg Co., NC Deed Book 17, p. 86.)
Notes: Back Creek rises in the north east part of Charlotte and flows generally north easterly into Cabarrus County where it enters the Rocky River. The larger portion of the creek is in present day Cabarrus County. That is what makes me believe this is John Stewart (1770), son of Thomas Stewart (d 1778) of Mecklenburg/Cabarrus.
Notes: When this land was sold in 1817, he was listed as John S. Stewart, and his wife was Mary. We know John of Cabarrus married Mary Davis in 1795, so that seems further evidence this is that same John.
On 10 Apr 1803, James Neel, Esquire, Sheriff of Mecklenburg, made a deed to Alexander Stewart, of Mecklenburg, land formerly the property of John Stewart known by the place he now lives ... Alexander Stewart being highest bidder ... $61 for 250 acres ... Gordon Potters line ... The waggon road ... both sides of 4 Mile Creek and includes John Stewarts improvements ... Signed by James Neil, Sheriff. Witnessed by J. McKnitt Alexander and William Neel. (Mecklenburg Co., NC Deed Book 18, p. 106).
Notes: This is John son of Alexander Stewart (d 1789). This deed is a little confusing because John had already deeded all of his land to son Alexander Stewart. This appears to be his 100 acres (1787), 25 acres (1793) and 125 acre (1793) tracts, leaving his 80 acre tract out. Why was this deed necessary? Normally a Sheriff’s deed is to settle a court ordered debt. If that was the case, then John had the debt, lost the court case, and his land was ordered sold to cover the debt. His son Alexander purchased it at auction which kept it in the family at least. This, despite Alexander already owning it.
On 24 Jan 1804, John Stewart made a deed to David Stewart, “both of Mecklenburg” for $400. The deed was for land Sugar Creek and McMichal Creek ordered to be sold per the Will of Alexander Stewart (indicating that Elizabeth, his widow had died by this time, apparently). It was 229 acres, which is less than the original 285 acres. John Stewart signed. Witnesses were James Campbell and James Neill. (Mecklenburg Co., NC Deed Book 18, p. 51.)
Notes: This is John Stewart (bef 1755-aft 1816) of Fourmile Creek, son of Alexander Stewart (d 1789). This was land inherited from his father via his 1789 Will.
There are three John Stewarts on the 1810 census in Mecklenburg.

p. 493 Jno Stewart 03201-11301-0-1 John (bef 1755) son of Alexander (d 1789)
On 7 Jan 1817 John S. Stewart and wife Mary of Mecklenburg made a deed to Hugh Dickson of same place. For $460 they sold land described as on waters of Back Creek. Wm Davies corner ... Querrys line ... Robt Mitchell’s line ... being 96 acres. The deed was signed by John S. Stewart and Mary Stewart. Robert Query was witness. It was proven “by grantors” in August court 1831. (Mecklenburg Co., NC Deed Book 22, p. 188.)
Notes: This is John Stewart (1770), son of Thomas Stewart (d 1778) of Mecklenburg/Cabarrus.

On 30 Nov 1821, James Willson, Esqr, Sheriff of Mecklenburg, sold land to James Morris, being seized from John Stewart Senr via court order (debts). The land was described as on both sides of Fourmile Creek including John Stewart’s old improvements. William B. Alexander and Duncan McCraven’s corner ... Morris’s corner ... 150 acres. Signed by James Willson, Sheriff. Witnessed by Cyrus Query and Robert M. Owens. (Mecklenburg Co., NC Deed Book 19, p. 372.)
Notes: This would seem to be John Stewart (bef 1755-aft 1816) of Fourmile Creek, son of Alexander Stewart (d 1789). However, I found no record of him coming by this land, unless some of that which he deeded/gifted to his son Alexander wound up in his hands again. Although the deed was dated 1821, it mentioned the auction was on 31 Aug 1820. It did not give the date of the court action.
