I (Marty Grant) am a 3rd Great Grandson of Jacob Waters and Emily Tanner.
Special thanks to my Grandmother Luella George Grant (deceased), my Great Aunt Marynell George Lequire, and my cousin Thelma Welch Swanson (deceased) and others for data shared on this family.
Jacob Jackson Waters was born 22 Apr 1842 (I'm not sure of the source for this birth date) in Macon Co, NC. The birth date above works well with his 1850, 1860, 1870 and 1880 census entries. His birth place would be somewhere in the Burningtown creek vicinity, or perhaps the Iotla Creek area.
Jacob was most likely named for his grandfather Jacob Fouts and his father Michael Jackson Waters. Family tradition says that he went by the nickname "Jake".
Jacob J. Waters is a son of Michael Jackson Waters and Rebecca Fouts. This is proven by several records, most notably the 1850 and 1860 census and his death certificate showing father as "Jackson Waters" and mother as "Rebecca Fouts".
Jacob's father died ca 1846, when Jacob was only about 4 years old. A Macon County court record shows that in September 1846, Samuel Waters (Jacob's Uncle) was appointed guardian of the infant heirs of M. J. Waters, deceased, namely Rebecca Watters (sic) (his wife), Louisa Waters (daughter) and "Madison Waters" (this has to be Jacob, but it clearly said "Madison"). (Macon Co, NC Court Minutes 1838-1855 pg 344).
Jacob's mother Rebecca, remarried in 1849 to Reuben Evans, a first cousin of Michael J. Waters. Presumably, Jacob was raised by Reuben as step son.
Jacob was home with his mother and step-father for the 1850 census in Macon Co, NC.

On 16 Jan 1859, Jacob Waters signed as the bondsman for the marriage of Levi Roper and Nancy Clampett in Macon Co, NC. Nancy was Jacob's first cousin (daughter of Richard Clampett and Elizabeth Fouts).
Jacob was still with his mother and step father for the 1860 census in Macon Co, NC.

Jacob J. Waters married Emily A. Tanner ca 1861, probably in Towns Co, GA. They undoubtedly met via her sister Mary Lucinda Tanner who married Jacob's 1st cousin William Riley Fouts ca 1858. I suspect that since William and Mary resided in Macon County, Emily must have come to visit, and therefore met Jacob Waters on such a visit.
I have not found a marriage record for Jacob and Emily, but since their first child was born in January 1862, I suspect they were married in late 1860 or early to mid 1861. No record was found in Macon County, but since she was from Towns Co, GA, they probably married there.
Emily A. Tanner was born 4 Sep 1840 (per tombstone) in Union (now Towns) Co, GA. She is a daughter of John Tanner and Susanna Stroud. She was home with her parents for the 1850 and 1860 census.
I've found no record of Jacob J. Waters serving during the Civil War.
Jacob and Emily were listed on the 1870 census in Macon Co, NC in Nantahala Township, just a few houses from his mother and step-father. They lived somewhere near Aquone or Briertown communities.

Emily A. Tanner Waters died in May 1875, quite possibly due to complications from childbirth (she had a child born in 1875). She is buried at Briertown cemetery which is in Macon County, NC very close to the Swain County border.
Jacob J. Waters married again on 14 Feb 1878 in Macon Co, NC to his 1st cousin Martha Jane Fouts. The marriage was performed by "Z. Barnes", Justice of the Peace. The marriage record showed them as "J. J. Waters" age 27, and "M. J. Fouts" age 24.
Martha Jane Fouts was born March 1849 in Macon Co, NC, daughter of James D. Fouts and Rebecca Barnes.
Jacob and Martha and family were listed on the 1880 census in Macon County in Burningtown Township very close to numerous relatives.

Sometime between 1880 and 1900, Jacob and Martha and family moved from the Burningtown area to Franklin (the county seat) and remained there. They were listed on the 1900 census in Macon County in Franklin Township.

Jacob and Martha were probably still in Franklin for the 1910 census, but I don't have that listing yet, nor the 1920 census.
Jacob Jackson Waters died in Macon Co, NC on 19 Jan 1923 in Franklin Township. (Macon Co, NC Death Records Book 4 page 123).
I don't know where Jacob is buried, perhaps somewhere in Franklin.
I don't know when Martha Jane Fouts Waters died. I still need to check the 1910 and 1920 census.
Jacob Jackson Waters and Emily A. Tanner had six children, and he and Martha Jane Fouts had five children, for a total of 11 children. These children are all proven by census records, and family knowledge.
Magnana "Nannie" Waters (c1873)
Annis Dulcenia Waters was born 4 Jan 1862 in Macon Co, NC. I don't know who she might have been named after. She was home with her parents for the 1870 census in Macon Co, NC.
Dulcenia married Aaron Alexander Wright on 17 Dec 1876 in Macon Co, NC. They lived out their lives in nearby Rhodo and Topton in Cherokee Co, NC. See their own page for additional information.
Florence I. Waters was born 1864/65 in Macon Co, NC. She was home with her parents for the 1870 and 1880 census in Macon Co, NC.
I did not find a marriage record for her, nor any other record of her after 1880. I don't know if she died between 1880 and 1900, or else married someone during that timeframe (or both).
Canby Alonzo Waters was born April 1868 (per 1900 census) in Macon Co, NC. He was home with his parents for the 1870 and 1880 census in Macon Co, NC.
Canby married Tallesa Virginia Garrison on 22 Jan 1899 in Macon Co, NC. She was born March 1876 in NC (don't know what county), daughter of Robert Pink Garrison and Sarah Ann Welch.
They must have moved to neighboring Cherokee County right away, for they were listed on the 1900 census in Cherokee Co, NC in Valleytown Township. Based on their neighbors, they must have been somewhere near Marble. Canby's brother John Waters was residing with them.

I have no record of Canby after 1900.
Buena Vista Waters was born May 1870 (per 1870 census) in Macon Co, NC. She was home with her parents for the 1870 census.
She was not found in 1880 or later census records, so I suspect she died ca 1870/1880 in Macon Co, NC.
Magnana "Nannie" Waters was born ca 1872/73 in Macon Co, NC. She was home with her parents for the 1880 census.
She was not found in 1900 or later census records, so I suspect she died ca 1880/1900 or married someone unknown during the same timeframe in Macon Co, NC.
John W. Waters was born January 1875 (per 1900 census) in Macon Co, NC. He was home with his parents for the 1880 and 1900 census in Macon Co, NC. He was also listed in 1900 with his brother Canby in Cherokee Co, NC. His birth date was given differently in each record. In his parents household he was listed as born January 1877, but with his brother, he was listed as January 1875, which seems more accurate.
I have no record of him after 1900.
Mallie Waters was born 12 May 1881 in Macon Co, NC.
Mallie married Thomas Alex Bateman on 23 Mar 1899 in Macon Co, NC. They were married by her cousin W. J. Evans. The marriage record gave their names as "Alex Bateman" age 23 and "Malia Waters" age 19.
Alex Bateman was born 24 May 1874 in Macon Co, NC. I don't know who his parents were.
Alex and Mallie were listed on the 1900 census in Macon Co, NC in Nantahala Township. Her sister Beulah was residing with them.

They were still in Macon for the 1910 census in Nantahala Township.

I don't have the 1920 census listings yet.
Thomas Alex Bateman died on 31 Dec 1975 in Macon Co, NC.
Mallie Waters Bateman died on 1 Oct 1976 in Macon County.
Although I was about 10 or 11 years old when they died, I never knew my Great Great Great Aunt and Uncle.
Beulah D. Waters was born October 1883 in Macon Co, NC. She was home with her parents for the 1900 census in Macon Co, NC, and also listed with her sister Mallie Waters Bateman in 1900, also in Macon Co, NC.
Beulah married her cousin W. Harley Roper on 6 Oct 1901 in Macon Co, NC. Harley was born August 1880 in Macon Co, NC, a son of Daniel Roper and Susan Caroline Fouts. Caroline was a child of James D. Fouts and Rebecca Barnes.
Apparently Harley and Beulah moved to Oregon briefly during the 1901-1908 timeframe, for their first child was born there ca 1907/08. They returned to Macon Co, NC in time for the 1910 census.

I don't have them after 1910. I have not yet checked the 1920 census.
Doctor Hanes Waters was born 24 May 1886 ("May 1886" proven by 1900 census, "1886" proven by tombstone, I don't know the source for his full birth date). He was born in Macon Co, NC.
Dock was home with his parents for the 1900 census in Macon Co, NC. I don't yet have him on the 1910 or 1920 census.
At some point, Dock married Nina Bell Teague, presumably in Macon Co, NC, but I found no marriage record there for them. They might have married in a neighboring county instead. She was born 2 Sep 1900 (tombstone says only "1900"). I don't know who her parents were.
Doctor Hanes Waters died 10 Mar 1971 in Macon Co, NC and Nina Bell Teague Waters died on 10 Jul 1982. They are buried side by side in the Fouts Cemetery in Macon County. His stone says "Dock H. Waters 1886-1971", and hers says "Nina T. Waters 1900-1982". My dad and I visited their graves in 1998.
Unfortunately, I never knew my Uncle Dock and Aunt Nina.
Lula Waters was born in Macon Co, NC, though I don't know when exactly. She was not listed with her parents on the 1880 census, so she must have been born after that.
Lula Waters married Andrew C. Painter on 25 Sep 1894 in neighboring Cherokee Co, NC.
I did not know about this daughter until my grandmother (Luella George Grant) began looking over my family history material one day, and asked me about her "Aunt Lou Painter". I said I didn't know who that was. She wasn't sure how she was related, but knew it was through the Waters family somehow. Later on (unfortunately, after grandmother's death) I found Lula Waters who married Andrew C. Painter. I'm making a big assumption that Lula is a child of Jacob and Martha. I've not seen any direct proof that she is their child, but it seems highly likely. I base this on several things. One, my grandmother knew she was her Aunt. Two, Martha Jane Fouts Waters reported in 1900 that she had 5 children, all 5 still living. Only 3 of her children are proven by the 1880 and 1900 census, leaving two unaccounted for. With Lula, only one was unaccounted for.
I'm confidant that Lula is Jacob and Martha's child, but I need to find some more data on her to be totally sure.
I did not find Andrew and Lula on the 1900 census in Macon Co, NC. They might have been there, as much of the census was very dim and hard to read. Since they married in Cherokee County, it is possible that they are there in 1900, though I've looked before and did not find them.
The fact that my grandmother knew Lula, or knew of Lula, (grandmother was born in 1924) means that Lula must have been somewhere in the area still.
Mary Waters was born in Macon Co, NC, though I don't know when exactly. She was not listed with her parents on the 1880 census, so she must have been born after that.
Mary Waters married Brownlow Pinkerton on 28 Feb 1897 in Cherokee Co, NC.
I have no additional data on this family. I also have no proof that Mary is a child of Jacob Waters, but I'm guessing based on the fact that several of Jacob's children married in Cherokee Co, NC in this same timeframe, and that they did have one unknown child who is unaccounted for, and Mary seems to fit the bill perfectly.
More data is needed on this family. I did not find them on the 1900 census in Cherokee or Macon Co, NC.
