I (Marty Grant) am a 5th Great Grandson of Michael Waters and Emelia Stewart.
Michael Waters was born ca 1765/70 (per census analysis). I dont know where he was born, though he lived in Cabarrus and Mecklenburg County, NC later on. I dont know if he was born in that area though or moved there from somewhere else. There is some family tradition that he had lived in Charleston, SC, but I dont know if that is true or not. More research is needed.
I have found no record of Michael Waters parents yet, nor of any possible siblings.
I did not find Michael Waters on the 1790 census, though he was certainly old enough to have been listed (20-30 years old then). I dont think he was married yet by 1790, so probably still living with his parents or other relatives. The only Waters in Western NC in 1790 were *Abram Waters and *Deep Waters in Burke County. Of course there were other Waters in eastern and central North Carolina. There were quite a few Waters in South Carolina in 1790, including some in Spartanburg and Pendleton Districts.
Michael was in the Mecklenburg / Cabarrus County area by the early 1790's. Cabarrus County was formed from North-Eastern Mecklenburg in 1792. I dont know if he arrived after Cabarrus was formed or before. I dont know what section of Cabarrus he lived in.
Michael Waters married Emelia Stewart before ca 1794 in Cabarrus Co, NC. She was born ca 1770/75, daughter of John Stewart and Mary Ann .
Michael Waters was listed on the 1800 census in Cabarrus County. He was the only Waters in the county. There was a Samuel Waters in neighboring Mecklenburg County that year. Michael was listed between the households of John Gray and John Vossel.

By 1806, Michael had moved his family into neighboring Mecklenburg County, and he was listed on the 1806 Mecklenburg County tax list as "Michael Waters" in Captain Kerrs Company. He was taxed for 1 white poll (himself) and no land.
Michael Waters was listed on the 1807 tax list in Mecklenburg in Captain David Moores Company. He was taxed for 1 white poll (himself), and 0 acres.
Michael Waters was listed on the 1810 census in Mecklenburg County. He was the only Waters in Mecklenburg County. He was listed between Charles J. Alexander and Robert Quary.

Michael Waters was listed on the 1815 Mecklenburg County tax list in Captain Laird H. Harriss Company. He was taxed for 1 poll (himself) and no land.
Sometime between 1815 and 1820, Michael Waters moved his family to Burningtown Creek area of Macon County (then still part of Haywood County). It is possible they didnt get to Burningtown that early, but they were in some part of Haywood County for the 1820 census. Unfortunately this census was alphabetical, so I cant tell where they were living, nor who their neighbors were. They were the only Waters family there. Emelias parents and siblings were in Haywood County in 1820, and some were just over the county line in Buncombe County.

Macon County was formed in 1828 from the western portion of Haywood County. Apparently the Waters were already there by the time Macon was formed.
Michael Waters was listed in one of the earliest court records of Macon County on 22 Jun 1829 when he was named in a list of "Venire Facias" (I dont know what this means).

Emelia Stewart Waters was listed as head of household on the 1840 census. She was next door to Eli Collins (son-in-law).

Emelia Waters died sometime before 1850, presumably in Macon County, though it is possible she moved away with some of her children and died with them.
Michael Waters and Emelia Stewart had several children, some are proven by various sources, but Ive not found a single source naming them all (such as a Will, Estate record, or Family Bible). The census records also seem to show some other unidentified children.
Unknown Daughter (1794/1800). Michael Waters had an apparent daughter this age. I have not been able to identify her yet. She was home in 1800 (age "under 10", born ca 1790/1800), and home in 1810 (age 10-15, born ca 1794/1800), and home in 1820 (age 16-25, born ca 1794/1804), and still home in 1830 (age 30-39, born ca 1790/1800), and possibly still home in 1840 (age 30-39, born ca 1800/10).
There was a Margaret Waters mentioned in several Macon County records in the 1840's. I wonder if this could be her. I have not been able to find out much about Margaret. She was clearly associated with the Michael Waters family, and I get the impression that she was an unmarried daughter.
On 2 Sep 1844 there were two deeds made to Margaret Waters. One was from James H. Waters for $100, being 110 acres on Burningtown Creek. Witnessed by Eli Collins and Richard Clampett. I don't know who James H. Waters is unless this is actually Samuel H. Waters mis-read. On the same date Saul H. Waters sold Margaret Waters 50 acres for $25. Same witnesses. Saul must be Samuel. I think both of these deeds are from Samuel H. Waters. (Macon Co, NC Deed Book D page 1855, and 1856).
On 22 Sep 1845, Margaret Waters sold 55 acres to Jacob Fouts for $50. She signed with a mark. Witnessed by S. H. Waters (brother Samuel H. Waters) and Richard Clampett (Fouts' son-in-law). I did not find a record of Margaret obtaining this land, so perhaps it was inherited from her father. (Michael Waters was granted 55 acres in 1838.) (Macon Co, NC Deed Book F page 91).
Margaret Waters sold her 110 acres to Peter S. Stalcup on 4 Nov 1846. The land was described as bordering Six Killer's Reservation. On the same date she sold her 50 acres to Stalcup. Witnesses to both were Joel Simmons and S. Waters (probably Samuel H. Waters). (Macon Co, NC Deed Book E page 211, and 212).
The above deeds are the last records I have for Margaret Waters. She did not appear on the 1850 census in Macon County. She may have died, or moved away with one of her siblings.
Keep in mind that I'm not totally sure that Margaret Waters was a daughter of Michael Waters, but that seems the best explanation for the records found.
Milly Waters was born ca 1794/1800 (per census analysis), presumably in Cabarrus Co, NC. She is a proven child of Michael Waters as listed on her 1817 marriage bond. She was apparently home with her parents for the 1800 census (age "under 10", born ca 1790/1800), and home in 1810 (age 10-15, born ca 1794/1800).
On 6 Oct 1817, Joseph McMullen (listed as Joseph McMulan Jr) obtained a marriage bond in Haywood County to marry Milly Waters, daughter of Michael Waters. Isham Evins (Evans) was bondsman.
Joseph was born ca 1790/94 (per census analysis). I don't know where he was born, nor who his parents were. The fact that he was listed as "Jr" on his marriage bond does not indicate his father was Joseph Sr, but only that there was someone in Haywood County at that time also named Joseph McMullen who was older than him. It could be his father, or an uncle, or older cousin.
There was one Joseph McMullen listed on the 1820 census in Haywood County. He was probably Joseph "Sr" instead of the one who married Milly Waters. It is possible that (if Joseph "Jr" was son of Joseph "Sr") that the younger Joseph and wife Milly were home with the elder Joseph, for there were people there in that household of the correct ages. I can't be sure of this, but here is the census listing anyway, just in case.

Joseph McMullen was listed on the 1830 census in Macon County. They were not near any of her Waters relatives as far as I can tell. There was an older woman living with them, perhaps Joseph's mother?

By 1840, the McMullens had either moved to neighboring Cherokee County, or had already lived in that area when it was formed from Macon in 1839. The older woman from 1830 was still with them apparently.

I didn't find them in 1850. There was a Griffin McMullen (c1819) in Haywood County that year with a Rachel McMullen (c1776 VA) living with them. Speculation leads me to think that this is Joseph's son (he had one born ca 1815/20), and that Rachel was his (Joseph's) widowed mother. The ages fit perfectly, and Griffin did name a daughter "Milly". There was also a Birton (Burton?) McMullen (c1827) in 1850 Haywood. He could be a son of Joseph.
Mary Waters was born ca 1799/1800 (per 1850 census) or ca 1794/95 (per 1860 census), in Mecklenburg Co, NC (per 1850 and 1860 census). She is a proven child of Michael Waters as listed on her 1817 marriage bond. She was apparently home with her parents for the 1800 census (age "under 10", born ca 1790/1800), and home in 1810 (age "under 10" born ca 1800/10).
On 29 Aug 1817 Zachariah Evans obtained a marriage bond in Haywood County to marry Mary Waters, daughter of Michael Waters. Isham Evins (Zachariah's father, I think) was bondsman. Zachariah was born ca 1794/95 in South Carolina (possibly Greenville District), a son of Isham Evans.
Zachariah and Mary moved to Macon County when her parents did, and remained there. See their own page for additional information.
Unknown Daughter (1800/10). Michael Waters had an apparent daughter this age. She was with him in 1810 (age "under 10", born ca 1800/10), but gone by 1820, so probably married or dead by then. I didn't find any marriage records that may be applicable.

Matilda Waters was born ca 1800/04 (per census analysis) either in Cabarrus or Mecklenburg Co, NC. She seems to be home with her parents for the 1810 census (age "under 10", born ca 1800/10), and apparently home in 1820 (age 16-25, born ca 1794/1804), and apparently home in 1830 (age 20-29, born ca 1800/10).
On 20 Mar 1834 James W. Murray obtained a marriage bond to marry "Metilda" Waters in Macon Co, NC. A. G. Love was bondsman.
I have no solid data on James W. Murray, but I found him on the 1840 census in Union Co, GA. Matilda's brother John S. Waters was also in Union Co, GA that year, but they were not listed near each other. As best as I can determine, the Murrays were living in that section of Union County that later became Towns County, Georgia.

I didn't find them in 1850.
John S. Waters was born ca 1803/04 (per 1850 census) presumably in Mecklenburg Co, NC. I have not seen direct proof that John S. Waters is Michael's son, but it seems very likely. They were neighbors, and Michael did have a son that age per early census records. It has been suggested that his full name was "John Stewart Waters", and if correct, then he was named for his maternal grandfather John Stewart.
John married Mary "Polly" --- before 1830 in Macon Co, NC. See their own page for additional information.
Lydia Waters was born ca 1806/07 (per 1850 census) in Mecklenburg Co, NC (per 1850 and 1860 census). She seems to be home with her parents for the 1810 census (aged "under 10", born ca 1800/10), and still home in 1820 (age 10-15, born ca 1804/10).
Sometime before ca 1828, Lydia married Eli Collins in either Haywood or Macon Co, NC (no marriage record found). Eli was born ca 1806/07 in South Carolina (county unknown). I don't know who his parents were. (I'm also a Collins researcher with roots in South Carolina, but I don't think Eli is connected to any of my Collins who were in eastern SC, for he was most likely from upper west South Carolina).
I was unable to locate Eli Collins on the 1830 census.
In March 1834 Court, Eli Collins surrendered himself to the court for some charges not given. (Macon Co, NC Court Minutes 1833-1836 pg 11)
In July 1835, Eli Collins gave bond so that he could be a Constable. Security was given by J. M. Waters (probably M. J. Waters, his brother-in-law), James D. Fouts, Alfred Hall, N. Hill, David Alla, Lemuel Mar and Ward Hill. (Macon Co, NC Court Minutes 1833-1836 pg 86)
In February 1836 Court, Eli Collins was sworn in as an Officer of Grand Jury. (Macon Co, NC Court Minutes 1833-1836 pg 124)
For the 1840 census, Eli Collins was listed in Macon County next door to his widowed mother-in-law Emelia Waters.

In January 1842 it was ordered that "Eli Collins have a reasonable allowance for keeping of Mary Stuart till next court and also ordered that whoever take paupers of this county shall give bond and security for their faithful performance" Mary Stuart was his wife's grandmother. They were listed on the 1880 census in Swain County. ** I don't have this entry typed up yet.
Nancy M. --- Collins died in 1889 and Eli Collins died in 1895. They were buried at the Judson Cemetery in Swain County. When Fontana Lake was built, their graves were moved to Lauada Cemetery in Swain County.
Samuel H. Waters was born ca 1811/12 (per 1850 census) presumably in Mecklenburg Co, NC. I have not seen direct proof that Samuel H. Waters is Michael's son, but it seems very likely. They were neighbors, and Michael did have a son that age per early census records. I don't know what his "H" middle initial stands for.

Jane Waters was born ca 1814/15 (per 1850 census) in Mecklenburg Co, NC. She seems to be home with her parents for the 1820 census (aged "under 10", born ca 1810/20), and still home in 1830 (age 15-19, born ca 1810/15).
On 23 Jun 1832, William R. Weaver obtained a marriage bond in Macon County to marry Jane Waters, daughter of Michael. Marvel Scoggins was bondsman. William Riley Weaver (his middle name was given to me by Lucille White) was born ca 1814/15 in Virginia (both facts per 1850 census).
By ca 1838, the family had moved to somewhere in Tennessee, perhaps Polk County where some other Waters went, and by 1840 the Weavers were in Pulaski County, Missouri and listed on the 1840 census there.
