John Roberts was born ca 1748 or earlier, possibly in the same area he lived in later in life: in Wayne Co, NC. In the 1748 timeframe, this area was still part of Johnston Co, NC. It remained Johnston until 1758 when Dobbs was formed, and remained Dobbs until 1779 when Wayne County was formed. I don't know for sure if John was born in that area or moved there later on.

John Roberts' first sure record is his appearance on the 1769 Dobbs Co, NC tax list. There were two John Roberts listed. The other may have been his suspected father John Roberts of Dobbs Co, NC. Both John's were charged for 1 white taxable and no blacks.

Sometime around 1770 or so, John Roberts married Nancy (---) probably in old Dobbs Co., NC. For years researchers (myself included) thought Nancy was the same Nancy Roberts named in the Will of Benjamin Smith (dated 20 Apr 1807 Wayne Co., NC), however I am now convinced that they are not the same person. The ages just don't work out. John Robert's wife Nancy is about the same age as Benjamin Smith, so couldn't possibly be his daughter. Benjamin Smith's children are in the same age groups as John & Nancy's children, so therefore Benjamin's daughter Nancy Smith Roberts must be married to someone else. John & Nancy's son Isaac Roberts was married to a Nancy (1772-1810), and it seems to me that she must be the daughter of Benjamin Smith. In fact Isaac and Nancy did name one of their sons "Benjamin" Roberts, a name which doesn't appear in other branches of the John Roberts family in the first few generations.

On 21 Sep 1772 John Roberts "of Dobbs" sold 100 acres to Jesse Pipkin in Duplin Co, NC. The land was described as being on the North Head of Wolf Branch, on Isaac Hines line, and the Great Pocosin, being a patent to John Roberts dated 22 Dec 1770. Witnesses were Samuel Albertson and Isaac Hines. I don't know exactly where this land was, but probably within the bounds of modern Duplin County not far from the Wayne and Lenoir county lines. I'm not entirely sure if this is John Jr of Wayne, or his supposed father John Sr of Dobbs. (Sampson Co, NC (actually Duplin) Deed Book 3 page 377)

On 23 Jan 1773 John Roberts and Henry Roberts were both listed as adjoining land owners to a 200 acre patent to Constantine Whitfield in Dobbs Co, NC. (Dobbs Co, Crown Patents 1759-1775 Book 22 page 124)

On 22 Jul 1774 John Roberts received a 100 acre patent on the South side of Southwest Creek and the Little Deep Run near Faircloth Revel. This is in the area of southwestern Lenoir County near the Duplin county line near the present Deep Run community. (Dobbs Co, Crown Patents 1759-1775 book 22 page 394)

In the 1773-1775 timeframe, John Erwin sold property to John Roberts in Dobbs Co, NC. This deed is lost, and is only known to us from the Grantor index. (Dobbs Co, NC Grantor Index 1773-1775 Book 10 page 16).

In the 1773-1775 timeframe, John Roberts sold property to Griffin Jones in Dobbs Co, NC. This deed is lost, and is only known to us from the Grantor index. (Dobbs Co, NC Grantor Index 1773-1775 Book 10 page 537).

In the 1777-1779 timeframe, Griffin Jones deeded property to John Roberts three different times. These deeds are lost, and is only known to us from the Grantor index. (Dobbs Co, NC Grantor Index 1777-1779 Book 11 page 14, page 15, and 463).

In the 1777-1779 timeframe, John Roberts again deeded property to Griffin Jones. This deed is lost, and is only known to us from the Grantor index. (Dobbs Co, NC Grantor Index 1777-1779 Book 11 page 366).

On 6 Jan 1778 John Roberts entered  100 acres on the North Side of the Trent River and Bear Harbour Pond in Dobbs County, NC. The head waters of the Trent River is in Southwestern Lenoir County, just below the present Deep Run community, so this land was near his other land. (Dobbs Co, NC Land Entries 1778-1790 Book 1 page 35)

On the same date, 6 Jan 1778, John Roberts also entered another 150 acres on the North Side of the Trent River, near head, and prongs of Deep Run. (Dobbs Co, NC Land Entries 1778-1790 book 1  page 36)

Also on the same date, 6 Jan 1778, John Parker entered 400 acres in the same area, listed as joining John Roberts. (Dobbs Co, NC Land Entries 1778-1790 Book 1 page 41)

One of the two John Roberts were listed on the 1779 voter list in Dobbs Co, NC. Can't be sure which John it was.

On 4 Feb 1779 Griffin Jones entered 150 acres in both Dobbs and Duplin Counties, listed as bordering John Roberts and George Ventress. (Dobbs Co, NC Land Entries 1778-1790 book 2 page 613)

On the same date, 4 Feb 1779, Griffin Jones entered another 150 acres on the North Side of the Trent River in Dobbs, adjoining John Roberts. (Dobbs Co, NC Land Entries 1778-1790 book 2 page 615)

On 16 Feb 1779, John Graddy entered 100 acres in Dobbs described as joining John Roberts and the widow Stephens. (Dobbs Co, NC Land Entries 1778-1790 book 2 page 648)

In 1779 Wayne County was created from the western half of Dobbs County. John Roberts lived in the new county of Wayne, but much of his land was still in Dobbs County, as well as Wayne and Duplin Counties.

On 10 Nov 1779 John Roberts received a State Grant for 150 acres in Dobbs Co, NC, on the North side of the Trent River. This is probably the same land he entered on 6 Jan 1778. (Wayne Co, NC Deed Book 2 page 36).

John Roberts was listed on the 1780 Dobbs Co, NC tax list with $36 worth of property. He was listed in District # 3, which includes the Deep Run area and some familiar names from the above records were included there, such as Isaac Hines, Jesse Pipkin, Constantin Whitfield and others.

On 18 Jan 1782 John Roberts was named as Executor of the Will of Richard Jones, along with Richard's wife Bershaby. (Wayne Co, NC Wills)

On 29 Oct 1782 John Roberts received a state land grant for 140 acres in Dobbs Co, NC on the North Side of the Neuse River near Long Meadows, adjoining Richard Jones. I think this was actually in Wayne county, but when originally entered, it was still Dobbs. (Wayne Co, NC Deed Book 2 page 32).

On the same date, 29 Oct 1782, John Roberts received another land grant, for 135 acres on the North Side of the Neuse River and south side of Walnut Creek, adjoining his own line and that of John Dixon and Martin Johnstone. (Wayne Co, NC Deed Book 2 page 40).

On 14 Apr 1783 Richard Jones sold John Roberts 8 acres on the North Side of Neuse River and west bank of Walnut Creek. Witnesses were Thomas Thompson and Davis George. (Wayne Co, NC Deed Book 1 page 196).

On 26 Apr 1785 William McKinne entered 314 acres on the Head of Walnut Creek, described as adjoining John Roberts, John Fellows, Aaron Wallace, Joseph Greens, and David Jernigan. (Wayne Co, NC Entries 1780-1795 # 143)

On 15 Nov 1785 Benjamin Harrison sold John Roberts 222 acres on the East Side of Reedy Branch and East Side of Stoney Creek. Witnesses were Joseph Green, Absalom Williams and Benjamin Stevens. This is somewhere in the vicinity of present Seymour Johnson Air Force Base, roughly between the City of Goldsboro and Walnut Creek (there are approximately six miles between Stoney creek and Walnut Creek). John Roberts was listed on the 1786 tax list for Wayne Co, NC in District 4, and charged for 1,022 acres of land, and 1 white poll (himself) and 1 black poll (a slave).

On 2 Oct 1787 John Roberts entered 150 acres on the North Side of the Trent River, and Bear Harbour Pond in Dobbs Co, NC. (Dobbs Co, NC Land Entries 1778-1790 Book 4 page 136)

On 20 Nov 1787 Josiah Stafford of Duplin Co, NC sold John Roberts of Wayne Co, NC 600 acres in Johnston Co, NC. This land was described as being on the south side of the Little River, and east side of Great Branch. Witnesses were Joseph Green and Charles Croom. I don't know where this was precisely, but it was roughly in the area of present Princeton or Pine Level. I can't imagine why John Roberts would have purchased land so far from where he lived, unless he was planning to move, or perhaps it was to settle a debt owed him by Stafford. Who knows. (Johnston Co, NC Deed Book TR-3 page 104).

On 29 Dec 1787 Benjamin Harrison sold John Roberts 302 acres on the East Side of Reedy Branch and the east side of Stoney Creek, adjoining Benjamin Vinson and James Handley. Witnesses were William Thomson, Dempsey Griffin and Reuben Hines. This land was probably near the other land Harrison sold him in 1785, somewhere in the Seymour Johnson Air Force Base vicinity. (Wayne Co, NC Deed Book 4 page 92).

On 3 Aug 1789 Joshua Garris of Wake Co, NC sold John Roberts 78 acres on the North Side of the Neuse River, and the East side of Casuway Branch, adjoining Jacob Herring, Martin Johnston, and John Roberts. Witnesses were Rodham Douglass, and Joshua Garris Jr. (Wayne Co, NC Deed Book 5 page 53).

John Roberts was listed on the 1790 census in Wayne Co, NC. He had 5 slaves at this time. His neighbors on either side were Rhody Douglass and David George. His other neighbors include several names well known in the Walnut Creek area, and also Benjamin Smith was just a few houses away. A close analysis of the land deeds of John's nearest neighbors may help to pinpoint where his home tract of land was. His 1790 census entry includes at least 2 "sons" and one "daughter" who I haven't been able to identify. They could be grandchildren instead, or boarders, or some other relatives.

On 5 Jan 1791 Travis Jones and wife Omey sold 70 acres to John Roberts between Walnut Pocoson, the Swamp, and Martin Johnson being "the Island land". Witnesses were R. Hamm and J. Dawson. Walnut Pocosin is on the north side of US 70 between 70 and New Hope Road. (Wayne Co, NC Deed Book 5 page 55).

On 12 Jan 1796 "Benjamin Smith (2)" sold 200 acres to John Roberts, on the south side of Walnut Pocoson near Roberts' line and Richard Jones' line. Witnesses were John Garland and E. Slocumb. The Benjamin Smith of this deed was the younger of the two Benjamin's in the area, hence the "2" by his name. (Wayne Co, NC Deed Book 5E page 293).

On 13 Dec 1797 John Roberts sold Spears Hamm 120 acres on the North Side of Neuse River. Witnesses were John Garland and B. McKinne. The deed doesn't say so, but Hamm was John Roberts' son-in-law. (Wayne Co, NC Deed Book 5E page 540).

On 15 Oct 1799 John Roberts gave his son Henry Roberts 162 acres on Reedy Branch, North Side of Neuse River, Hamm's corner "for natural love and affection to my son." Witnesses were Caleb Howell and John Pickering Jr. (Wayne Co, NC Deed Book 7 page 39).

John Roberts was listed on the 1800 census in Wayne Co, NC, apparently in the same area as before. Many of his neighbors were the same names from many of the previous deed records above. John's neighbors on either side were Jacob Wipper and Joshua Garris. For this census, John Roberts had nine slaves.

On 21 May 1800, William Smith, Sheriff of Wayne Co, NC sold John Roberts 110 acres on the south side of Walnut Pocoson on Richard Jones' line. This was from the Estate of Thomas Thompson and sold for damages per a court order. Witnesses were: Exum Smith, Benjamin Shephard and William Johnston. (Wayne Co, NC Deed Book 7 page 98).

On 17 Aug 1801 Jesse Hall sold 200 acres to John Roberts, land on the North Side of Neuse River on Dawson's Branch. Witnesses were: William Smith and Joseph B. Boyett. (Wayne Co, NC Deed Book 7 page 209).

On 3 Sep 1801 John Roberts gave property to his son John Roberts Jr "for natural love and affection to my son." (Wayne Co, NC Deed Book 7 page 386).

On 8 Jul 1802, John Roberts witnessed the deed of Randolph Rogers of Duplin Co, NC to John Roberts Jr of Wayne Co, NC for land in Duplin Co, NC. Witnesses were John Roberts, Reuben Searles and John Croom. (Duplin Co, NC Deed Book N page 451).

On 21 Jul 1802, John Roberts proved the deed of Randolph Rogers to John Roberts Jr in Duplin Court.

John Roberts died sometime prior to February 1803, for on that date Henry Roberts and Isaac Roberts were named administrators.

In July 1803, John Roberts' heirs petition the New Bern District Court (which was the State court covering several counties, including Wayne) for a division of the estate of John Roberts. The following is an almost complete transcript of that record:

Isaac Roberts, Stephen Grant and his wife Patience, Anne Roberts, Owen Roberts, Bright Roberts, Polly Roberts, (the latter 4 minors) by their next friend Isaac Roberts, complain that John Roberts of Wayne County, died intestate owning 1000 or 1500 acres in Wayne County, 600 acres in Lenoir County, 600 in Johnston County, and 975 acres in Duplin County. that he left a widow Nancy Roberts and 9 children: Charite Roberts married to Spyers Ham, Henry Roberts, John Roberts & the above said petitioners. The petitioners state that after Charite Roberts married Spyers Ham, John Roberts gave a deed to Spyers Ham for 110 3/4 acres in Wayne County on Ready Swamp on the prong of Stony Creek, William Ham the father of Spyers paying to said John Roberts 75L. that said John Roberts gave to his son Henry Roberts, 200 acres joining the same, and to his son John Roberts 975 acres in Duplin County, but no allotment to the rest of his children. the widow had received dower of 509 acres in Wayne Co. Petition for division. Commissioners: Richard Croom, Benjamin Smith (Taylor), John Gaylord, William Smith, Barney McKinney. 1 Oct 1803 Division of the lands of John Roberts, decd. Isaac Roberts drew the Hall & Johnston land of x00 acres. Anne Roberts drew the Trent land in Lenoir County of 670 acres. Patience Grant drew 422 acres. Owen Roberts drew 66 acres and the Walnut Pocoson called the Jernigan land of 200 acres. Bright Roberts drew 200 acres. Mary Roberts drew 227 acres. Plat shown.

John Roberts has a fairly large Loose Estate File at the NC Archives containing several documents, a few of great interest, inventories, estate sales, petitions from the heirs, etc.

One document dated 10 Sep 1805 shows the estate of John Roberts being divided into 9 shares, 1 each to: Spyus Ham, Henry Roberts, Isaac Roberts, Stephen Grant, Jesse Harper, Owen Roberts, Bright Roberts, Polly Roberts, and the widow.

A letter with no date was in the file, but one reference within the letter shows it was from 1814 or later. I had abstracted this from the original, but never got around to typing it up. Fortunately, Martha Barnes had already done it, and here is her typed version of this document:

State of North Carolina

Wayne County

To the Honorable the Judge of the Court of Equity of the County of Wayne

Humbly complaining shew unto your honor your orators Burwell Boyte and Mary his wife of the County of Wayne that John Roberts late of the County of Wayne died intestate in the year (left blank) leaving Henry Roberts & Charity the wife of Spires Ham and Isaac Roberts, Anne Roberts, Patience the wife of Stephen Grant, Owen Roberts, Bright Roberts and your Oratrix Mary since intermarried with your Orator Burwell his children and heirs at Law - the said John Roberts died seized and possessed of several tracts of land situate in the Counties of Wayne and Lenoir - application for partition of which said lands among the heirs of the said intestate was made by petition to the Superior Court of Law of Newbern district and it appearing to the said Court that Henry Roberts & Charity Ham - two of the said children had had lands settled upon them by their deceased in fee simple equal to the share which had descended to the other children respectively it was ordered and adjudged by said court at the term of (left blank) that partition of the lands of which the said John Roberts died possessed should be made between the said Isaac Roberts, Anne Roberts, Patience Grant, Owen Roberts, Bright Roberts and your Oratrix Mary pursuant to which order the said lands were divided into six shares of equal value and allotted to the said heirs in severalty, the said partition was duly returned to the Superior Court aforesaid at November Term 1803 approved and confirmed and the said heirs entered into the possession of the respective tracts allotted

to them in severalty-

Your Orators further shew unto your Honor that there was allotted to your Oratrix Mary as her share of the said lands in the said partition a tract containing two hundred and twenty-seven acres situate on Walnut Creek in Wayne County-At the term of (left blank) of Wayne County Court an action of Ejectment was brough by David Thomson, Richard Thomson, Stephen Thomson and Elizabeth Thomson against William Smith who as tenant of your Orators was in possession of the said land for the recovery of the said land so allotted to your Oratrix - to which suit your Orator Burwell was permitted to be made defendant - the case was tried in the said County Court, and it appeared that the title of the said land had been in one Thomas Thomson who died seized of the same, that under an execution issued on a Judgement obtained by John Roberts against the Administrator of said Thomas Thomson, and without (suic facies-?) served on the heirs of said Thomson, the said land had been sold and purchased by said John Roberts and that-the persons suing for the same were the heirs at law of said Thomas Thomson - a verdict and Judgment was rendered against your Orator from which your Orator appealed to the Superior Court of law of Wayne County in which Court the case was tried at April Term 1814 and the superior title of said heirs of Thomas Thomson being manifest as herein before stated, a verdict and Judgment was rendered against your Orator and by the process of said Court your Orators have been evicted of one hundred and eighty four acres of the land allotted as aforesaid and

subject to the payment of One hundred dollars, costs of said suit - In concequence of which eviction the several joint heirs and late tenants in Common with your Orators became liable to contribute to your Orators their respective equal shares of the value of said land and the amount of said Costs and your Orators aver that the land of which they have been thu? evicted is of the value of One thousand dollars -

Your Orators further shew unto your Honor that Anne Roberts intermarried with Jesse Harper of Wayne County and has died seized and possessed of her share of said lands leaving Isabella Harper, Kenyon Harper and James Harper all of whom are infants her children and heirs at law, to whom the said share of said lands allotted to the said Anne has descended - The said Stephen Grant and Patience his wife have sold their share fo the said lands and are insolvent - Your Orators have in a friendly way applied to the said Isaac Roberts, Owen Roberts, and Bright Roberts and the said Isabella, Kenyon, and James Harper and requested them to pay your Orators the proportion of the value of the land from which your Orators were evicted as aforesaid and the cost attending the suit for the same, which they respectively are bound to contribute as well as a proportion of the share of the said Stephen Grant and wife to which from the insolvency of said said Grant & wife they are bound to contribute - But awith this reasonable request they have refused and still do refuse to comply -

In tender consideration whereof for as much as your Orators are without remedy but by the interpo-

page 4 - sition of your Honor in a Court of Equity To the End that the said (left blank) Isaac Roberts, Owen Roberts, Bright Roberts, Stephen Grant and Patience his wife and Isabella, Kenyon, and James Harper may upon their respective (can't read) oaths, true, direct, and infact answer make to the primises as fully and particularly as if the same were here again repeated and they officially thereunto interrogated, particularly that they may set forth whether the lands aforesaid did not descend, were not held in common and were not divided as herein before set forth: whether each tennant in common has not received, and held and enjoyed or disposed of their shares respectively alloted them:  Whether the title of the said John Roberts to 184 acres part of the land allotted your Oratrix was not defective and whether the same has not been evicted from the possession of your Orators by the Inferior Title of the heirs of Thomas Thomson as heirs before stated and whether the said Stephen Grant and wife are not insolvent: That the said Isaac Roberts, Owen Roberts, Bright Roberts, Stephen Grant and wife and Isabella, Kenyon and James Harper may be compelled by decree of your Honor to contribute and pay their norman respective shares of your Orators loss and expense as according to the premises and in Equite they ought to contribute and pay, and that your Orator may have such other and further relief in the premises as the nature of their case may require.  May it please your Honor to Grant your Orators writs of (can't read) directed to the said Isaac Roberts, Owen Roberts, Bright Roberts, Stephen Grant and Patience his wife and Isabella, Kenyon, and James Harper commanding them to appear before your Honor at the Court of Equity to be held in the County of Wayne on the first Monday after the fourth Monday of December next.

We know that John Roberts died in 1803, but we don't know when his widow Nancy died. She was not listed on any additional record as far as I've found.

Henry Roberts had an "extra" female with him in the 1810 census, aged 45 and up (born before 1765). This could be his mother Nancy, but there is no way to be sure. Since Nancy wasn't listed as an heir in the 1814 petition, then she was probably dead by then.  

Children of John Roberts and Nancy. The Estate records of John Roberts in 1803 through 1814 name 9 children. Census records may indicate at least three more children.

Charity Roberts was born ca 1775/1784 in Wayne Co, NC, presumably in the Walnut Creek area or that general vicinity. She was apparently home with her parents for the 1790 census.

There is a book on the Ham family that contains alot of information on Spias Ham and descendants and other branches of the Ham family. I don't have an exact reference for it, but will try to find out who wrote it and such.

She married Spias Ham before 13 Dec 1797 in Wayne Co, NC. On that date (13 Dec 1797) John Roberts sold 120 acres on Richland Swamp and Reedy Branch to Spias Ham. The estate records for John Roberts said that this was deeded after Charity Roberts married Spias Ham. (Wayne Co, NC deed book 5E page 540).

I didn't find them listed on the 1800 census, though they may have been residing with Spias' father William Ham, who wasn't too many houses from John Roberts in 1800.

Spias and Charity were named in the Estate records of her father. Charity had 110 and 3/4 acres that her father had deeded to Spias Ham in 1797 (the deed said 120 acres). The 1803 estate document stated that John Roberts gave a deed to Spias Ham for land on Ready Swamp on the prong of Stony Creek, William HAM the father of Spyers paying to said John ROBERTS 75L. In other words, Spias father William paid for it. Since they already had this land, they didn't receive any additional inheritance.

On 23 Nov 1803, Spias Ham, and several other heirs of William Ham, sold property to Benjamin Ham Jr. (Wayne Co, NC Deed Book 7 page 450).

Spias Ham was listed on the 1810 census in Wayne Co, NC. They were listed next to Charity's brother Henry Roberts and near various other familiar names, many who were residents of Walnut Creek.

On 19 Feb 1811 "Spyus Hamm" sold the 120 acres inherited from John Roberts to Waitman Frazier. Charity, wife of Spias, was not mentioned in this deed. This can be explained since this land was sold to Spyus Ham, and not really inherited from John Roberts. Waitman Frazier later sold this same land to Henry Roberts in 1820, so it came right back into the family. This deed (the 1811 one) was witnessed by Charles Croom and Burwell Boyet. (Wayne Co, NC Deed Book 9 page 302).

Spias and Charity Ham moved to Moore Co, NC between 1811 and 1815 and I found no other record of them in Wayne Co, NC.

"Speas Ham" was listed on the 1815 Tax list in Moore Co, NC, and listed with 755 acres, valued at $756. His brothers-in-law Bright Roberts, Owen Roberts and Isaac Roberts were all there too by then.

Spias Ham was listed on the 1820 census in Moore Co, NC. His brother-in-law Bright Roberts was listed also, but several pages away.

The Ham family left Moore Co, NC and moved to Marion Co, Alabama prior to 1830. They were listed there on the 1830 census. I don't have the enumerations yet though.

By 1840 they had moved to neighboring Fayette Co, AL, or else they lived in that small section of Marion that was annexed to Fayette in 1831, or another bordering section annexed in 1837. They were listed in Fayette Co, AL for the 1840 census. I don't have the enumerations yet though.

Both Spias Ham, and his wife Charity Roberts Ham, died between 1840 and 1850, in Fayette Co, AL. Several of their children were still in Fayette Co, AL for the 1850 census.  

Henry Roberts was born ca 1775/80 in Wayne Co, NC, presumably in the Walnut Creek area or that general vicinity. He was apparently home with his parents for the 1790 census, though possibly married already that year. His wife may have been with him at John Roberts house. Henry married twice, first to a Miss Nixon and second to Zilpha Carraway. See his own page for additional information on him.  
Isaac Roberts was born ca 1774/1784 in Wayne Co, NC, presumably in the Walnut Creek area or that general vicinity. He was apparently home with his parents for the 1790 and 1800 census.

He married before ca 1807 to Nancy Smith who died just a short while later. His second wife was Charity Cox. See his own page for additional information on him.

John Roberts was born ca 1780/84 in Wayne Co, NC, presumably in the Walnut Creek area or that general vicinity. He was apparently home with his parents for the 1790 and 1800 census.

John Roberts (Jr) married first to Mary Lawhon and second to Ann Hines Pipkin (widow of a Mr. Pipkin). See his own page for more information on him.  

Patience Roberts was born ca 1784/85 in Wayne Co, NC, presumably in the Walnut Creek area or that general vicinity. She was apparently home with her parents for the 1790 and 1800 census.

Patience Roberts married Stephen Grant between ca 1800 and ca 1803. See his page for more detailed information on this family.

Stephen Grant and Patience Roberts drew 422 acres from her father's estate. The same records show that they sold their share of the property before ca 1814. Deed records show they sold it to Isaac Roberts, Patience's brother in 1811:

On 19 Jul 1811 Patience Grant and Stephen Grant sold 444 acres to Isaac Roberts (brother of Patience Grant). The land was described as being on the west side of Walnut Creek and being her (Patience) part of her father's estate. The deed also sells "one dividing" of 22 acres formerly of Joshua Garris (this 22 acres was land sold by Garris to Stephen Grant in 1804). (Wayne Co, NC Deed Book 9 page 371).  

Anne Roberts was born ca 1765/84 in Wayne Co, NC, presumably in the Walnut Creek area or that general vicinity. She was apparently home with her parents for the 1790 and 1800 census.

She married Jesse Harper between 1803 and 1805 in Wayne Co, NC and since she inherited her father's Lenoir County property, they resided there. John Roberts' estate records show that Ann drew the "Trent land in Lenoir" being 670 acres.  Jesse Harper married several times, and Anne Roberts might have been his 2nd wife or possibly 3rd. I think he married at least once more after she died. It is possible Anne was married to a younger man named Jesse Harper and not the one who had several marriages. That isn't certain, but other Jesse Harper (Sr) researchers dont include the marriage to Anne Roberts, so perhaps she does belong with the younger man of the same name.

They were listed on the 1810 census in Lenoir Co, NC. The Trent River land in Lenoir County was approximately 10 miles from where she was born in Wayne Co, NC. Jesse Harper "Sr" was listed next to "Jr" who was three houses from David George, who had been John Roberts neighbor in 1790 Wayne Co, NC census. Most of the children listed with Jesse in 1810 were from a previous marriage, but three of these were probably his and Anne's, though I don't know their birth dates, so I can't be sure, other than they were all born between ca 1803/05 (when Jesse and Anne married) and 1814 when we know Anne was dead. She may have already been dead by the time of the 1810 census, but I don't know that for sure. Perhaps a Jesse Harper researcher might know.

The 1814 Petition found in John Roberts estate papers showed that Anne Roberts, wife of Jesse Harper had died by that time (1814) leaving three minor children: Isabella, Kinyon and James Harper.

I don't know what became of the lands the Harpers inherited from John Roberts, since, unfortunately, most of the Lenoir County records were destroyed in two court house fires in the late 1800's. Jesse Harper is a well researched individual, claiming many descendants, yet for some reason, none of them knew about his marriage to Anne Roberts, though it is well documented. I believe the reason for this oversight is that the documentation is in Wayne County, and no one thought to look there, since he never lived in that county.

Jesse Harper was listed on the 1820 census in Lenoir County, and beyond that I have no information on him at present.  

Unknown Son born ca 1774/1784. The 1790 and 1800 census records seem to show John Roberts with an apparent son born ca 1774/84. At first I thought this was either Owen Roberts or Bright Roberts, but other records make it clear these children were not that old. They were both considered "orphans" in 1810, meaning they were still under 21 at that time (or born no earlier than ca 1789/90). Based on that, it would seem this "son" born ca 1774/84 is not either of them. Since no other sons were named in the 1803-1814 estate records for John Roberts, this child may have died unmarried. Unknown Daughter born before 1790. The 1790 census shows John Roberts with 5 females residing with him. Four of these are easily accounted for: His wife Nancy; daughters Charity, Patience, and Anne. John's daughter Mary wasn't born yet by 1790 (unless born that very year). One possibility is that this is a daughter who died unmarried, before John died (1803). Another is that this is actually Mary Roberts, if she was born in 1790 before the census taker came (I currently show her birth at ca 1790/1794). Another possibility is that this was a niece or other relative residing with the family. One possibility that I like, is that this could be Henry Roberts first wife, Miss Nixon, as it seems they were married by 1790, as their first child was born that year, yet he was not listed as head of household on the 1790 census.  
Owen Roberts was born ca 1790/94 in Wayne Co, NC, presumably in the Walnut Creek area or that general vicinity. He was apparently home with his parents for the 1800 census, and apparently with his brother John Roberts in 1810.

They later moved to TN.

Mary "Polly" Roberts was born ca 1790/94 in Wayne Co, NC, presumably in the Walnut Creek area or that general vicinity. She was apparently home with her parents for the 1800 census.

She was named in her father's estate records variously as "Mary" and "Polly" Roberts (Polly is a nickname for Mary). In the division of John Roberts' lands, Mary drew 227 acres. These same records showed she was a minor (under 21) in 1803. This puts her possible birth years at 1782/1803, however, an 1810 record still shows her as a minor, so that moves it up to 1789/1803. John Roberts had a daughter with him in 1800 aged "under 10", or born ca 1790/1800. I feel sure this is Mary, as that was the only possible one that could have been her.

In February 1810, Henry Roberts, her brother, was named as being guardian of orphans Bright Roberts, Owen Roberts, James Carraway, Miss Nancy Carraway and Polly Roberts. (The Carraway's were siblings of his wife Zilpha Carraway Roberts). This record shows that Mary was still under 21 and still unmarried in 1810. (Wayne Co, NC Estates Book 1 page 236 and 237).

There was no female Mary's age residing with Henry Roberts for the 1810 census, so she must have been somewhere else. Although he was legal guardian for her, and his two brothers and his brother and sister-in-law, that doesn't mean they resided with him, only that he was legally responsible for them. It seems that Owen, Bright and Mary were all living with their brother John Roberts (Jr) in 1810, as he had extra people in his household who are a perfect age fit for those three.

Mary Roberts married Burwell Boyette (usually spelled without the last "e" in most of the records I've found) between February 1810 and January 1811, or at least before 1814.

I did find Burwell Boyette listed on the 1810 census in Wayne Co, NC, but I don't know if he was already married to Mary by then. He was listed next door to Thomas Boyette, which was his grandfather's name, but this might be an Uncle of the same name instead. His household had alot of people in it, including one about Mary's age, so I'm not sure who all of these folks are. They are probably his mother and siblings, since it seems that Shadrack (his father) died between 1806 and 1810.

On 18 Jan 1811 Bright Roberts sold his share of his father's lands to Burwell Boyet, being 223 acres on the North Side of Neuse River, Mill Swamp and Walnut Creek, bordering "Polly Roberts line". Witnesses were John Roberts and Owen Roberts, his brothers. (Wayne Co, NC Deed Book 9 page 384).

The 1814 petition found in John Roberts' estate file was initiated by Burwell Boyette and Mary Roberts. (See above).

On 6 Jun 1815 Burwell and Polly Boyet sold property to Joel Altman in Wayne Co, NC (I don't have details yet). (Wayne Co, NC Deed Book 10 page 216).

On the same date, 6 Jun 1815, Burwell Boyett witnessed a deed from Owen Roberts to Joel Altman for land on Walnut Pocoson. (Wayne Co, NC Deed Book 10 page 218).

The 1815 deeds were the last record I found for them in Wayne Co, NC. They did not appear there on the 1820 census. I don't know if they moved away, or if they died. I don't have the details of the 1815 deed, but it probably will show that they sold the land she inherited from John Roberts and also the land they purchased from Bright Roberts which adjoined it.

There was a "Burrell Boyett" listed on the 1830 census in Covington Co, AL. I don't know yet if that is the same person or not. He was there in 1840 as well. In 1850 he was widowed (so I don't know if his wife was named "Mary" or not). Listed as age 57 (born ca 1792/93) and in NC. His age and birth place and name all fit, so it is quite possible this is the same family. There was also a widow Mary Boyett listed there, age 66 (born ca 1783/84 her birth place wasn't listed), listed next to a Bennett Boyett age 54 (c1796) born NC. Bennett is the right age to be the younger brother of Burwell based on the 1800 and 1810 census records.

With no other candidates to choose from (as far as I've been able to find, anyway), I'm going out on a limb and saying this "Burrell Boyette" in 1830, 1840 and 1850 Covington Co, AL is the same one from Wayne Co, NC, who married Mary Roberts ca 1810/11. Further research will be needed to be totally sure though.

The 1830 entry for "Burell Boyett" disagrees in age with his 1840 and 1850 entries (all three give different ages for him).

In 1840, Burwell is closer to his 1850 age, and Mary's age seems to agree with what I had on her from NC records.

In 1850, Burrell is residing with William Boyette age 26 (c1824) born GA, presumably his son. This shows they left Wayne Co, NC after 1815 and moved to GA before 1824 before moving to Covington Co, AL by 1830. I checked the 1820 GA census,  but didn't locate them there.

From the "funny coincidence department", I had known about these Boyette's in Covington Co, AL for a couple of years, because a Sarah Ann Boyette born 1826 in GA married my cousin Jesse Oliver Bryan there ca 1840. In 1850, they were only five houses from Burrell Boyett, and it looks to me like Sarah Ann could be a close relative of Burwell. Especially considering she was also born in GA (just like his son William). At the time, it didn't occur to me that this was the same Boyette family connected with my Roberts family.
