- !NOTES:Marty Grant's 5th Great Grand Parent.;
!NOTES:Jacob Fouts is generally believed to be a son of John Leonard Fouts and Catherine Shearer. To date I've seen no solid proof of this. There is circumstantial evidence to support it though:
1. Jacob was born in Rowan, but moved to Wilkes and Ashe soon after birth. John Leonard also lived in those places at the same time.
2. Widow Catherine Fouts went from Ashe to Macon Co., NC when Jacob Fouts did in the 1830's. Suggests she is closely related. However, I've seen no proof that she is widow of John Leonard Fouts, or that her maiden name is Shearer.
More research is needed to determine who Jacob Fouts parents are for certain;

STATE OF NORTH CAROLINA.
To the Sheriff of Ashe County, greeting:
You are hereby commanded to take the bodies of Jacob Baker, George Hauk & Jacob Phouts if to be found in your county, and them safely keep, so as to have them before the Judge of our Superior Court of Law, to be held for the county of Ashe at the Court House in Jefferson on the 3rd Monday in September next, then and there to answer Charles Span in a plea of debt the sum of one hundred & fifty dollars which they owe and detain to plaintiffs damage one hundred dollars
Herein fail not, and have you then and there this Writ.
