The author (Marty Grant) might be a descendant of John and Patience, but that hasn't been proven. I suspect that my ancestor Daniel Turner (c1796) is their grandson, but I have no solid evidence of that.

John Turner was probably born in the 1730's or 1740's, somewhere in eastern North Carolina or perhaps in south-eastern Virginia. The first record we have for him is dated 1769 in Halifax (now Martin) Co., NC. It is possible he was born and raised in that area.

John Turner was a "mulatto man" according to a 1769 deed wherein his wife Patience (Smith) Turner purchased his freedom from Thomas Weathersbee Sr. In later records John was referred to as free colored. Depositions and statements made much later referred to him as being half white and half black. Based on those statements and tentative DNA evidence it appears that John's father was a white man and his mother a black woman, probably a slave at the time. "White" and "Black" are subjective terms regarding race, but in this case "white" means of western European origin while "black" means of African origin. Some descendants claim there is Native American in the family, but I've seen no evidence of that, but it is possible.

The name of John's parents are completely unknown. It isn't known if Turner was his birth name or a name he acquired later in life. No record of him has been found prior to 1769. There were several Turners in Halifax Co., NC in this time period.

John Turner married Patience Smith in the early 1760's, apparently while John was still a slave. Patience's birth date is unknown. Her father's name isn't known, but her mother was Rachel (---) Smith according to statements made a generation or so later. She may have been of Irish origin and been about 1/4 black herself (per the various statements). I have not yet attempted to trace the Smiths of Halifax and Martin Co., NC to see if I can identify her family.

To avoid confusion I should point out that there was another John and Patience Turner in neighboring Northampton County at this time. They are not the same John and Patience. Her maiden name was Lassiter.

On 22 Jul 1769 Thomas Weathersbee, Senior, Planter of Halifax County, sold to Patience Turner, of same place, for 60 pounds, a mulatto man named John. Witnessed by Jonathan Cain, Jesse Bryan, Henry Medford, and William Bryan. (Halifax County, North Carolina Deed Book 11 page 144).

By itself the above deed wouldn't tell us much. However this very same deed was also recorded in the Marion Co., SC Court House about 30 years later. Why was that? Obviously the Turners brought it with them when they moved to South Carolina as proof of John's emancipation. Since he was a "mulatto" it was very important that he could prove that he wasn't a runaway slave. (Marion County Loose Records, published in Pee Dee Queue, Vol. XXVIII, No. 6, Nov-Dec 2004, p. 5)

The section of Halifax County where they lived became Martin County in 1774, but they were already gone by then having moved to what is now Marion Co., SC probably in 1769.

The area they moved to was part of Georgetown District, South Carolina when they arrived.

In 1785 several "counties" were created within Georgetown District. They had no governments of their own at this time. Liberty County covered the region where the Turners lived. Most of the Georgetown County records were lost during the Civil War, so we have precious little data on the Turners between 1769 and 1800.

John Turner is listed on the 1786 tax list in Georgetown District in Prince Frederick Parish. He was taxed for 100 acres.

For the 1790 census John Turner was listed in Georgetown District in Prince George Parish (the census taker didn't refer to the counties within Georgetown). John was the only Turner listed in Prince George Parish. There were six other Turners listed in neighboring Prince Frederick Parish. It is important to note that the Parish lines are almost impossible to figure out. Most of those in neighboring Prince Frederick lived in what is now Florence County and down seem to be related to John Turner. However, two of those listed there were John's sons John (Jr.) and Reuben. They were listed as white.

Unfortunately the 1790 census is alphabetical so we can't see who John's neighbors were. It is also unfortunate that this census lumped all free colored persons into one column with no regard to age or sex. It makes analysis very difficult.

In 1794 a petition was made by "people of colour" in Georgetown District who were against the imposition of a poll tax against them. The signatures included William Turner, John Turner, Jr., John Turner Sr, Mildred Turner, Jenelayer? Turner, and Catherine Turner. Each signed with a mark. I don't know where this petition can be found. This information was shared with me by Joanne Pezzullo in 2005.

John Turner signed a petition on 5 Dec 1796. This was residents of Liberty and Kingston Counties asking for a new county to be created so they didn't have to travel so far to the court house. John Powers and Samuel Hussey also signed. (Pee Dee Queue, Vol. XXXI, No. 6, Nov-Dec 2007).

On 7 Mar 1797 John Turner and Zachary Cater witnessed a deed from Daniel Miers of Liberty Co., SC to James Myers of same place for two slaves (Protroe, a boy, and Mary). (Marion Co., SC Deed Book A, page 128).

John was mentioned in a deed dated 9 Dec 1797 wherein John Sanders of Liberty County sold 400 acres to Enos Tart for £20. The land was described as beginning at James Blackmon's corner, to Peter Coldor's line, to Thomas Hulan's corner, Ruben Turnor's corner, John Turnor Sr.'s line and Charles Oates line, being part of two grants to John Sanders dated 1 Feb 1793. Witnesses were John Tart and Enos Tart Jr. (Marion Co., SC Deed Book D page 178).

The above deed tells us who several of the Turners neighbors were.

In 1798 Liberty County became Marion District and was no longer part of Georgetown District, effective in 1800.

John was mentioned in a deed dated 16 Jan 1799 wherein John Sanders sold 300 acres to Levi Solomon. The land was described as joining John Turner Senior's corner, up Betheys (Bethea's) road to Thomas Hulens corner, thence joining Enos Tart's line, then to Turners again, being part of a grant to John Sanders dated 7 Feb 1792. (Marion Co., SC Deed Book G page 33).

John Turner is listed on the 1800 census in Marion District, Liberty County. His daughter Milly Hussey is a few houses away. John's next door neighbor on one side was Barbary Conner, and Osborne Lane on the other side. Unfortunately once again the free colored persons are all lumped into one column with no regard to sex or age groups.

John Turner died sometime between the 1800 census and 30 Jan 1807 for on that latter date he was referred to as deceased in a deed. (Marion Co., SC Deed Book I, page 104).

I don't know when Patience Smith Turner died, probably in the same general time period as John.

No Wills, probate or equity records have been found pertaining to John or Patience's estates. Apparently the heirs divided up their land amongst themselves in a deed or series of deeds, but those deeds haven't been found. They were referenced in another deed though, so they must have existed at some point.

Their children and grandchildren had to deal with the issue of their racial origins again and again. Several statements were filed in the deed books and court minutes that address this subject. I'll present those statements in chronological order, with commentary if needed. Most of these come from published transcripts or abstracts. The originals should be consulted for comparison purposes and fuller transcripts obtained.

1822 - Willis Finklea's Statement

22 Apr 1822. Willis Finklea Senr sayeth he lived with a woman named Olive Simmons near the Cape Fear River who often told him she had seen Patience Turners mother, wife of John Turner Sr, decd and Mrs. Simmons often told him she was a white woman of the Irish breed & the mixed blood came by a black man & heard old Mr. Abraham Dew say the mother of Patience Turner was a white woman. Comment: This statement is about Rachel (---) Smith, mother of Patience (Smith) Turner, though Rachel isn't mentioned by name here. Who was Olive Simmons? The Cape Fear River flows through North Carolina and never enters South Carolina. It flows through several counties including Bladen, Brunswick, Columbus and New Hanover which are all relatively near Marion Co., SC. The 1790 census shows several Simmons in Brunswick Co., NC (Ann, Benjamin (2), Isaac, John (4), Moses and Thomas) and in Bladen (Jeremiah, John, Sanders) and in New Hanover (Thomas). Willis Finklea didn't say when he lived with Mrs. Simmons.

1840 - Robert Hussey

21 Mar 1840 Marion Dist., SC Judgment Roll # 4344 concerning Robert Hussey's race, whether he has to pay special tax or not: Robert Hussay vs. the State. "We find that the relator is a free mulatto." (from jury). Says he is a free white ... not a negro or mustezo but a free white. His great grandmother was a free white woman named Rachael Smith of Irish descent of Halifax Co., NC. She died leaving a female child named Patience Turner. Around the American Revolution Patience Turner removed to Marion Dist., SC. She has since died leaving several children including Mildred Turner who married Samuel Hussey a free white man of English descent. They are parents of Robert Hussey, your petitioner. Sarah Martin was a daughter of Penny Turner a daughter of Patience Turner; who married John Martin. I've been recognized as a white, been on patrol duty, muster duty, maintained good character... and has voted without denial of rights until October last. Wit: Ed. B. Wheeler, John Blackman, John Ward, Henry Berry, Hugh Godbold, Alexander L. Gregg, H. G. Fladger, Moses Mace, Barfield Moody, Isham Watson and Joel Fore.

Comment: Robert Hussey (c1798-1858) is a son of Samuel Hussey and Mildred Turner. Mildred is a child of John and Patience. "Sarah Martin" is the same person (I think) as Sarah Turner who married John Powers.

1840 - Henry Turner

21 Mar 1840 Henry Turner ads. The State He further sheweth that his Great grand mother was a free white woman by the name of Rachael Smith who resided in North Carolina, That the said Rachael Smith died leaving a female child named Patience Turner so named & reputed in the county & vicinity of the said Rachael Smith. That sometime about the American Revolutionary War the said Patience Turner removed to Marion District, South Carolina. That the said Patience Turner has since died leaving John Turner who intermarried with Lula Hatchcock a free white woman and who are the father & mother of your petitioner Henry Turner.

And your petitioner Henry Turner further sheweth and suggests unto your Honors that his father John Turner was a soldier in the war of the American Revolution under Genl. Marion….

1840 - John Turner

1860 - Re: Martin W. Turner vs N. C. McDuffie, Sheriff

Before me George M. Fairlee, Magst - come John Blackman, Sr. and James Lane, Sr. and upon being sworn says they knew John Turner alias Jack Turner and he was a free man so treated and received that he was a mulatto one half white and one half colored, that Patience Turner his wife passed and was received as a free white woman not having more than one fourth negro blood. That Reuben Turner was one of their children and passed and was received as a free white man, that Reuben Turner married Dolly Martin a free white woman without the least mixture of African blood, that Martha Turner alias Patty Turner was one of their children, who lived passed and was received as a free white woman that Martin Turner who is her son is the reported son of Needham Watson who was a white man without any mixture. That they deponents know that Martin Turner attended school with the children of the neighborhood, mustered and performed road duty ever since he was old enough. That he has always behaved himself in a respectable and orderly manner and that they have always received him as a white man at their house and so treated and dealt with him, and that he bears in his neighborhood (in which we live) a good character, is quiet, peaceable, sober and industrious. Martin M. Turner (c1820-1890) is a son of Martha "Patty" Turner (and Needham Watson is reputed father). Martha is a child of Reuben Turner and Dorothy Martin. Reuben is a son of John and Patience.

1860 - Re: Martin W. Turner vs R. J. Gregg, Tax Collector

Fi Fa for capitation tax: Martin W. Turner VS Robt J. Gregg On 17 Sept. 1860 Should not be enforced because he says that he is a free white man and therefore not subject to capitation tax.

 17 Sept. 1860 John Blackman, Sen. - In Re Martin W. Turner: 17 Sept. 1860 The State of South Carolina, Marion District, Personally Carne John Blackman Senr., and under oath saith that he knew John Turner the grandfather of Martin W. Turner as a free person of color and also Patience Turner the grandmother of said Martin W., that the said John Turner was half white and half African, that the said Patience was judging from her color and from reputation one fourth African blood. This deponent further states that he knew the father of said Martin W. the offspring of said John and said Patience, his name was William, that he intermarried with one Catharine Martin a white woman and be her had several children and among them the said Martin W., and deponent believes that said Martin W. is only an eighth African blood and very probably less that his character is and always has been good and his reception in Society has, always been that of a free white man. Turner, that so far as deponent knows he has always enjoyed the rights and exercised the privileges of a white man, that he was several years Captain of the Cross Road beat Company, 32 Regiment S. C. Militia that during his Captaincy, the said Martin W. Turner performed Militia duty as any other man of his command. Deponent further states that the said Turner, though somewhat Stained, has always been received in the Community as a free white man. Sworn before me Sept. 17 th , 1860, w. W. Sellers, Not. Pub. W. Turner, that he was one half white and half African, that he was free, that he also knew Patience Turner the grandmother of said Martin, that he does not know the proportions of white and African blood in Patience but that she was considerably lighter than her husband the said John, that William Turner their son was the father of said Martin W. that he, the said William Turner married one Catherine Martin a white woman by whom he had several children and among them the said Martin W. Turner. This deponent further states that said Martin W. Turner has always so far as he knows enjoyed privileges of a white man and been received in society as such. The State of South Carolina, Marion District: Personally came James W. Bass and under oath saith he has known Martin W. Turner for many years, that as far as deponent knows he has enjoyed the rights and immunities of a white man. States that he was Captain of Cross Roads Beat Company, 32 Regiment, S. C. Militia for several years, that during his captaincy the said Martin W. Turner mustered in his company as any other man of his company. Deponent further states that though the said Martin has the appearance of being Stained, yet his reception in society has always been that of a white man. Sworn before me, Sept. 17 th , 1860 W. W. Comment: Martin W. Turner (c1816-aft 1880) is a son of William Turner and Catherine Martin. William is a son of John and Patience.

 

Children of John Turner and Patience Smith. Six children of John and Patience are proven by various records. The Darlington District court case of Powers vs. McEachern names them as does various deeds and other court records. Sarah Turner (wife of John Powers) is either a daughter or grand-daughter of John and Patience.

Reuben Turner was born ca 1760/65, probably in Halifax (now Martin) County, North Carolina. He married Dorothy Martin before 1790, probably in the Catfish Creek area, the area that later became Marion District.

Reuben is a proven son of John and Patience. In 1815 he sold 163 acres of land to Francis Bridges. In 1819 Bridges sold the same land, and in his deed, he gave the title history, he described it as being land from John Turner Sr to his son Rubin Turner and from R. Turner to Francis Bridges. Reuben was also listed as a son of John and Patience in the Darlington Court case. An 1860 Court record also proves that Reuben was John's son.

John Turner Jr was born ca 1765, in Halifax (now Martin) Co, NC. He married Juda Hathcock before 1790, probably in Catfish Creek area, the area that later became Marion District. He later married Lydia.

John Turner was associated with his brothers Reuben and William Turner in various records, but the only proof I've seen that he is a son of John and Patience is the Darlington Court case.

William Turner was born ca 1767/68 in South Carolina (per 1850 census). His wife was Catherine Martin. He lived in the Catfish Creek area, the area that later became Marion District. William is a proven son of John and Patience. He sold 50 acres of land to Francis Bridges. In 1819 Bridges sold the same land, and in his deed, he gave the title history, he described it as being land from John Turner Sr to his son William Turner and from him to Francis Bridges. William was also listed as a son of John and Patience in the Darlington Court case and in the 1860 Marion court records.

Catherine Turner was born ca 1774/75, probably in the Catfish Creek area, that later became Marion District, SC. She was mentioned as "Coty" in the Darlington court case, but I don't think it listed her husband.

She was probably home with her parents for the 1790 census, though John Turner's household was enumerated simply as 10 "Other Free" persons, with no age or sex breakdown. Catherine was certainly one of the 10 family members.

Catherine Turner married Barnabas Hathcock between 1790 and ca 1794. Barnabas was born ca 1765/74 (per census analysis). I don't know who his parents were, or what his supposed ethnic origin might be, though I've seen studies on the Internet showing the Hathcocks were of Indian origin. They were often listed as "free colored" just as the Turners were.

They were listed on the 1800 census in Marion District, just two houses from Catherine's brothers John Turner Jr and Reuben Turner. The entire family was listed as "Free Colored", and were not individually enumerated, so it makes census analysis difficult.

On 30 Jan 1807 Barnabas Hathcock of SC, Planter, deeded 163 acres to Christopher Dew for $100. The land was described as being the property of Hathcock by heirship on northeast side of Catfish Swamp. A deed from the heirs of John Turner deceased to Barnabas Hathcock was mentioned. (I have not found that deed in the deed books, perhaps it was never filed or lost somehow.) Signed by Barnabas Hathcock. Witnessed by Charity Dew and John (X) Martin (his brother-in-law). Catherine Turner Hathcock wasn't mentioned on this deed, though technically she should have relinquished her dower rights. (Marion Co., SC Deed Book I page 104).

Barnabas Hathcock was listed on the 1810 census in Marion District, SC.

Barnabas was mentioned as a neighboring land owner in a deed dated 5 Jan 1819 wherein John Powers and Sarah Powers (Catherine's sister or niece) sold 100 acres on Catfish to John Bridges. See Penny's section below for more on this deed. (Marion Co., SC Deed Book H page 109).

On 14 Aug 1819 Barney Hatcock of Marion District sold 163 acres (more or less) to George Rawls of the same place, for $300. The land was described as having been granted to John Turner in 1785 and from John Turner to Hathcock, bounded on the southwest by a grant to Harrison Lucas, northwest by a grant to John Turner, east and southeast by land that now belongs to John Bridges. Signed Barney Hathcock. Witnesses were Jesse Moody, Francis Bridges and D. Simmons. Catharine Hathcock, wife of Barnaby Hathcock relinquished her dower rights before B. Moody on 21 Aug 1819. Barnabas Hathcock was listed on the 1820 census in Marion District, SC. Unfortunately, this census was alphabetical, so I can't determine who their neighbors were. Several family members were in the "White" columns, and several in the "Free Colored" columns.

I didn't find them on the 1840 census. There was a Barnabas Hathcock in Bibb County, Alabama in 1840, but he was a younger man (born ca 1790/1800) and had also been there back in 1830. I was also unable to locate sons William and Thomas Hathcock in 1840. There were two Thomas' in Bibb, but neither was a good match for this Thomas, and there was a William in Dekalb Co, GA, but not a good match.

Barnabas Hathcock died before 1850, possibly in Covington County, Alabama for that is where I found Catherine living in 1850. She was listed twice on that census, once with son Thomas and again with son William. Her entry with Thomas gives her birth place as South Carolina, while William's gives North Carolina, and also lists her as "Insane" (senile).

I have no data on Catherine after 1850. Son William was still in Covington County in 1860, but Catherine was not with him. I didn't find her son Thomas in 1860.

Penelope Turner was born sometime between ca 1760 and ca 1780 most likely. I can't be more specific as I have found no census records or other sources to prove her approximate birth date.

Penny Turner married John Martin and they were the parents of Sarah Martin according to several of the 1840 court records mentioned earlier.

The identity of John Martin is difficult to determine as there was more than one man of that name in Marion County in the early 1800's. It stands to reason that he is a brother or somehow closely related to Dorothy Martin (c1765/70) who married Reuben Turner, and Catherine Martin (c1765/84) who married William Turner, both men being Penny's brothers.

A quick look at the 1790 census for Georgetown District shows a few Martin households. In Prince Frederick Parish: Zachariah Martin and Francis Martin (residing with William Sessions). In Prince George Parish: John Martin, Elias Martin, Moses Martin, Thomas Martin, Elizabeth Martin. We know from the 1806 Will of James Martin (not listed in 1790) that he was brothers to John, Elias and Thomas, as well as David, Mary, Ann and Sarah. I don't know who their parents were.

Is John Martin, brother of James, David, etc. the one who married Penny Turner? I scoured the Marion deeds, probates, etc. for any mention of John and Penny. I found many references to John Martin, but none for her except the 1840 Court records mentioned earlier. Those didn't say whether Penny and John were still living at that time, or where they lived. There are numerous records I haven't looked at yet, so more information may be waiting to be discovered.

The records found show that there was a John Martin, Sr. born before 1765 who was in Marion through the 1820's at least. Records dated 1809 and 1811 indicate his wife was named Winniford, or Winny for short. This John is listed on the 1790 census, but not found in 1800, but back again for the 1810 census and the 1820 census. This is probably the John who is a brother to James, David, et al. In 1820 a "G. John Martin" appears, born ca 1775/94 per that record. He is probably the same one in Marion for the 1830 census listed just as John Martin, born ca 1770/80, wife same age group.

From the above it seems unlikely that John Martin Sr. is Penny Turner's husband unless she died before 1809 and he remarried. That is certainly possible.

It is also possible that John and Penny left Marion early on and left few if any records in that county. There are some records there that clearly show an association with the Turners. I've abstracted all the interesting records for anyone named John Martin through the 1820's at least. Keep in mind that these may not be the right John Martin.

The 1790 census shows John Martin in Georgetown District. He was in Prince George Parish.

There was no one named John Martin listed on the 1800 census in Marion District or in any neighboring counties. There was a James Martin listed, as well as Aaron Martin, Patience Martin, David Martin and Thomas Martin. I believe that Aaron (married Elizabeth Bryant) is a son of John Martin. David and Thomas are John's brothers. I don't know who apparent widow Patience Martin is.

On 25 Mar 1801 John Martin and John Irwin witnessed a deed from Samuel S. Scott wherein he bound himself to Savage Smith & Co of Georgetown, Merchants. (Marion Co., SC Deed Book A, page 165).

John P. Martin is mentioned in a deed dated 5 Jul 1802 wherein Leonard Dozier, Sheriff of Marion District sold land to John Ford, Esquire. The land was sold to pay damages and costs in a court case where William Goodyear, Deceased, via John Ford, Administrator was indebted to John P. Martin for $100 plus interest and $38.78 in damages. (Marion Co., SC Deed Book B page 141). John P. Martin is referred to as being of the City of Charleston in another deed (dated 25 Jan 1808, Book D page 109), which shows he probably isn't the same person we are interested in.

John Martin was named in the 11 Apr 1806 Will of James Martin as his brother. Other siblings named were: David Martin, Mary Robin, Ann Miller, Sarah Martin, Elias Martin and Thomas Martin. (Marion Co., SC Probate Roll # 495).

John Martin and Charity Dew witnessed a deed on 30 Jan 1807 between Barnabas Hathcock and Christopher Dew. John signed with a mark. (Marion Co, SC Deed Book I page 104). This deed may be our John Martin as Barnabas Hathcock would be his brother-in-law.

On 25 Feb 1808 John Martin and Robert Moody, Jr. witnessed a deed from Martha Martin to Sarah Martin for 14 head of cattle and sundry household items. No relationship was stated between the various Martins. (Marion Co., SC Deed Book E page 40).

John Martin Sr and John Martin are listed on the 1810 census in Marion District. John Sr. (bef 1765) is two households from his son Aaron Martin. The other is listed next door to John Turbeville. The enumerations for both John Martins are identical so this must be a duplicate and not two different men. Other Martins listed in Marion in 1810 include Aaron, Elias, Elias, Thomas, Thomas, and James.

Since both entries are identical, I'll only give one here for analysis. However, it is interesting that John is listed as Sr. on one of the entries which suggests there was another adult John Martin in the county then. It is possible the entries aren't duplicates but two different families that just happen to have the same enumerations.

On 6 Feb 1811 John Martin Sr. deeded 112 acres to James Norton for $100. The land was on the north side of Maiden Down Swamp being part of a tract originally granted to Joseph Harrelson. John signed with a mark. Witnesses were Solomon Owens and William Norton. Weniford Martin, relinquished her dower rights before Robert Hodges, QU (no date). This deed wasn't recorded until 8 Jan 1829. (Marion Co., SC Deed Book M page 205).

The above deed shows John Sr.'s wife as "Weniford" (Winniford or Winnifred). This means that Penny was dead by then, or that this is a different John Martin. "Winne Martin" witnessed a Will dated 20 Aug 1809 (Dreadzel Reynolds), so assuming that is the same person, Winny was married to John Martin by then, and Penny was dead (or off somewhere else with her different John Martin).  Elias Martin and William Allin were the other witnesses to the Will. (Marion Co., SC Probate Roll # 670 Dreadzel Reynolds)

On 30 Oct 1814 John Martin, Martha Meloy and John Blackman witnessed a deed from Rueben Turner to Robert Turner his son. (Marion Co., SC Deed Book F page 231). John signed with a mark. This could be our John Martin since Reuben Turner is his brother-in-law.

On 20 Dec 1816 John Martin Sr. of Marion District, Planter, sold 100 acres to Aaron Martin for $50. The land was no the north side of Maidendown Bay being the lower part of a grant to John Martin dated 1778. John signed with a mark. John Carmichael and Samuel Smith were witnesses. No wife was mentioned to relinquish dower rights. (Marion Co., SC Deed Book I page 123).

On 4 Jul 1818 John Martin of Marion District, Planter, sold 122 acres to Isam Watson, Planter, of same place for $50. The land was on or near Catfish Swamp bounded by Barnabas Hathcock, James Crawford and Jesse Bryant. John Martin made his mark for a signature. Witnesses were Jesse Harel and Enos Tart. John's wife wasn't mentioned for relinquishing of dower rights. (Marion Co., SC Deed Book I page 124). This could be our John for Barnabas Hathcock was his brother-in-law.

On the same date (4 Jul 1818), John Martin and Enos Tart witnessed a deed from Jesse Harrell to Isham Watson for land near Buck Swamp. (Marion Co., SC Deed Book H page 53). John signed with a mark.

On 5 Jan 1819 John Powers and Sarah Powers sold 100 acres on Catfish to John Bridges for $300. The land was bounded on the west by William Turner, south by Barnabas Hathcock and John Martin, east by William Bryan and John Turner. John and Sarah both signed the deed with a mark. Witnesses were Thomas Jones and Francis Bridges. Sarah relinquished her dower rights before Barfield Moody, QU on 22 Jan 1819. (Marion Co., SC Deed Book H page 109). Sarah (Turner) Powers is John Martin's step-daughter, I believe.

There were two John Martins in Marion for the 1820 census. This one is alphabetical so I can't tell who any of their neighbors were. They were listed side by side, but in an alphabetical list that may not be relevant.

John Martin was mentioned in a deed dated 23 Feb 1820 wherein Thomas Brown Sr. of Marion District sold 138 acres to Thomas Brown Jr. The land was described as being on the south side of Maiden Down Swamp, one part of an 18 acre tract conveyed by Benjamin Harrelson to John Martin. One other part of a tract conveyed to John Martin by Isaac Atkinson for 15 acres. The residue of 105 acres being granted to John Martin and conveyed by him to Thomas Brown Sr. (No dates were given for any of these transactions, but I'd imagine they pre-dated 1800 since not found in the Marion deed books.) Witnesses were William Norton, James Norton and Stephen Brown. (Marion Co., SC Deed Book I page 275)

On 21 Dec 1820 John Martin Sr. of Marion District gave 80 acres to his grandson Aaron Martin Jr. "in consideration of love." The land was on the south side of Buck Swamp on Maiden Down Bay being part of 260 acres granted to John Martin 12 Feb 1789. The land adjoined Aaron Martin Sr. John signed with a mark. Witnesses were Hugh Harrelson and Matthew Martin. (Marion Co., SC Deed Book I page 464).

On the same date (21 Dec 1820), John Martin Sr. gave  80 acres to his grandson John Martin Jr. The land was described exactly the same as the deed to Aaron Martin Jr. and had the same witnesses. (Marion Co., SC Deed Book I page 465).

On 14 Sep 1827 John Martin and Matthew Martin witnessed a deed from Elizabeth Cribb to her son Anthony Cribb for land on Buck Swamp. (Marion Co., SC Deed Book L, page 87).

Only one John is listed in Marion in 1830 it is probably John G. Martin from 1820, based on the ages. That means that John Sr. and Winny may have died or moved away by this time. I found no estate records for them.

On 24 Sep 1831 John Martin Jr. and wife Elizabeth sold a tract of land to David Perritt, being 96 1/2 acres on south side of Buck Swamp on the Maiden Down Bay being part of a 260 acre grant to John Martin Senr dated 12 Feb 1789 joining land belonging to Aaron Martin Jr and John D. Witherspoon. Witnessed by John Collins and Thomas Collins. (Marion Co., SC Deed Book Q page 39). This deed is for the John Martin Jr. who is the grandson of John Martin Sr and wife Winny, I believe. I don't know who John Jr.'s father might be.

John Jr.'s wife is Elizabeth Hays as proven by an 1837 Equity record shows that Benjamin Hays, deceased left a Will dated 1 Jan 1835 leaving to John Martin one dollar and to his wife Elizabeth Martin a slave.

The 1840 census for Marion shows only one John Martin, he is in his 30's or born ca 1800/10. That isn't the same one from the 1830 census, but it might be the one who married Elizabeth Hays, being a grandson of John Martin Sr and Winny.

By 1850 there were only two John Martins in Marion, one age 40 (ca 1809/10) and one age 36 (ca 1813/14). Neither of them are the John we seek.

Mildred Turner was probably born sometime between ca 1760 and ca 1780. I haven't found any records to help narrow down her birth date any more. Mildred or "Milly" married Samuel Hussey ca 1791. He was born before ca 1774 per his age on the 1790 census.

Samuel was listed on the 1790 census in Georgetown District, SC. He was the only one of his surname in the county.

Samuel Hussey (and Reuben Turner and William Turner) signed a petition in 1794, though it was labeled as residents of Lynch's and Jeffery's Creek. That is in the region that later became Florence County. There was an unrelated set of Turners down there which included ones named William and Reuben, so is this our Turners? I don't think it is, but it could be. The presence of Samuel Hussey is interesting. He may have lived there awhile, or perhaps the petition included people who didn't actually live in that area. (Pee Dee Queue, Vol. XXIX, No. 2, Mar-Apr 2005. p. 1.)

Samuel Hussey signed another petition on 5 Dec 1796. This was residents of Liberty and Kingston Counties asking for a new county to be created so they didn't have to travel so far to the court house. John Powers and John Turner also signed. (Pee Dee Queue, Vol. XXXI, No. 6, Nov-Dec 2007).

Samuel Hussey apparently died between ca 1798 and 1800 for Milly is listed on the 1800 census as an apparent widow. She is just a few houses from her father.

I didn't find Milly on the 1810 census. She was listed on the 1811 tax list as "Mildred Hussey" and taxed 12 cents. She was listed in 1814 also as "Milley Hussey" and taxed 49 cents.

She may have died by 1819 for on 16 Jan 1819 the heirs of Samuel Hussey, deceased made two deeds dividing their inherited land. In the first deed Samuel Hussey, Martha Hussey, James Lucus, William Hussey and John Hussey sold 57 acres to Robert Hussey. The land was described as being on Catfish Swamp bounded by William Hussey, William Turner and Martha Hussey, being part of a tract granted to Benjamin Blackman and conveyed by him to John Turner, deceased, and by him to Samuel Hussey, deceased, "now we the heirs of said Hussey do ..." sell the land. Witnesses were Isham Watson, Thomas Finklea and B. Moody, JQ. (Marion Co., SC Deed Book S page 386).

In the other deed the heirs were Samuel Hussey, William Hussey, Robert Hussey, James Lucus, and John Hussey selling 47 acres to Martha Hussey. The land was described the very same way except bordering James Lucus, William Hussey and Robert Hussey. Same witnesses also.  (Marion Co., SC Deed Book S page 386).

Sarah Turner was born ca 1790/1800 per her age on the 1830 census. She may be a grandchild of John and Patience instead of their child. I'm not certain. She is definitely part of the family as proven by court records. Her marriage to John G. Powers, their children, their separation and the racial issue are all discussed at length in the case Powers vs. McEachern in Darlington Co., SC and in the South Carolina Supreme Court.

In the 1840 court cases mentioned earlier, "Sarah Martin" daughter of Penny Turner and John Martin is mentioned several times, though not in context. The cases in question weren't about her so why was she mentioned? I think Sarah Martin and Sarah Turner may be the same person, but I'm not 100% certain of that. Her marriage record and the other court records list her as a Turner each time. Perhaps she was born out of wedlock to Penny Turner before she married John Martin (who could indeed be her father). That is just a guess at this point, but I thought I'd point out the possibility.

Sarah Turner married John G. Powers on 4 Jan 1813 in Marion Dist., SC. The marriage date is given in Powers vs. McEachern. They were married by Tapley Moody (see deed dated 4 Nov 1834 below).

John G. Powers was born ca 1786/87 per his age on the 1850 census (63). He was born in South Carolina, perhaps that section of Georgetown that later became Marion. I don't know who his parents were. The 1790 census shows a Jiles Powers in Prince George Parish of Georgetown District (living with Edward Brown), and a John Powers. Either of these (or neither) could be John G.'s parents.

The 1800 census shows John Powers (bef 1755) in Marion District with many children. There was also a younger man named John Powers (c1755/74) listed in Marion with no children. They were the only two men of this surname in Marion at that time.

In 1810 there was Darby Powers (c1765/84), James Powers (c1784/94), John Powers, Sr. (bef 1765), Archibald Powers (c1765/84), John Powers, Jr. (1765/84). John G. would have been about 23 then. Darby had two boys that age with him in 1810 and John Sr. had one.

On 12 Mar 1814 John Powers sold 200 acres to William Altman for $200. The land was described as being part of a tract  of 1923 acres on Sister Bays, surveyed for John Flowers on 23 Aug 1791 and granted 5 Mar 1792. Witnesses were John Altman and Thomas Altman. John Powers signed with a mark. No wife was mentioned for relinquishing dower rights. (Marion Co., SC Deed Book N, page 221).

On 13 Feb 1816 John Powers and John Finklea Jr. witnessed a deed from John Finklea to Joel Fore. (Marion Co., SC Deed Book L page 3). John Powers didn't use a mark on this deed.

On 5 Jan 1819 John Powers and wife Sarah Powers sold 100 acres on Catfish to John Bridges for $300. The land was bounded on the west by William Turner, south by Barnabas Hathcock and John Martin, east by William Bryan and John Turner. John and Sarah both signed the deed with a mark. Witnesses were Thomas Jones and Francis Bridges. Sarah relinquished her dower rights before Barfield Moody, QU on 22 Jan 1819. (Marion Co., SC Deed Book H page 109). The deed didn't  explain how they came by this land. Perhaps it was part of Sarah's inheritance since it bordered some of the Turners.

The 1820 census shows only one John Powers in Marion, and he is John W. Powers (c1775/94). He is also listed on various deeds as John W. or "J. W." Powers. That is clearly not the same person as John G. Powers. John W.'s wife was Nancy Ann McLellan daughter of Angus McLellan (proven by Marion Co., SC Deed Book L, page 226 and 228).

On 4 Aug 1823 John Powers (signed with mark) sold 100 acres to Joel Fore for $1.00, the land being on Catfish Creek being land granted to Giles Powers 6 Dec 1752. (Didn't say how John Powers came by it though). Witnessed by John Finklea and John Mace. (Marion Co., SC Deed Book L page 1).

On 7 Mar 1824 John Powers, Planter of Marion District, sold 150 acres to Elly Gasque, Sr for $250. The land was part of a tract granted to Jacob Frost 5 May 1788. Witnessed by Enos Tart, W. Hale, Jr. No wife was listed to relinquish dower rights. (Marion Co., SC Deed Book L, page 173).

John G. Powers and Sarah Turner Powers separated in the 1820's. He "remarried" to Sarah Conner before ca 1828. Apparently there was no actual wedding for after his death she and her children were referred to as mistress and illegitimate offspring. They did live as man and wife for many years.

The 1830 census shows one listing for John Powers and two for Sarah Powers. John was listed as age 15-19 (c1810/15) so that isn't the same John. Both Sarah's had similar, but not identical, enumerations. The census is alphabetical so all the Powers are listed near each other. John W. Powers had moved to Marlboro District by 1830. John G. Powers was in Darlington in 1830.

On 24 Apr 1830 George Sweat of Marion District, sold 50 acres to Sarah Powers of Marion District for $80, being land granted to John Sanders bounded on the east by Osborne Lane, and the south by William Bryant and by William Turner on all other sides. (Marion Co., SC Deed Book S, page 387).

On 4 Nov 1834 Tapley Moody made a statement: "This may certify that I did lawfully join together in matrimony John Powers and Sarah Turner." Signed 4 Nov 1834. Witnessed by Susannah Moody and George Powers. (Marion Co., SC Deed Book P, page 76).

For the 1840 census I couldn't find Sarah. She was still in Marion as late as 1844 (assuming the deed below is the same Sarah Powers, and that her place of residence was given correctly). John G. Powers was in Darlington in 1840.

John G. Powers died in 1867 in Darlington District, SC. He left a will leaving his estate to his wife and children. He probably meant Sarah Conner and her children, but he didn't specify, and a lawsuit ensued when the children by Sarah Turner found out about it.

Sarah Conner Powers is listed on the 1870 census in Darlington: Flood Township, Florence PO, # 51/51 Ervin Powers 40 Farmer SC; Emily 35; Caroline 16; Della 2; Eliza 1/12 (or 10/12); Brantley 13; Sarah A. Powers 67; Flanders Anderson 11 black, Domestic Servant.

I didn't find Sarah Conners Powers on the 1880 census.

Where was Sarah Turner Powers in 1840 and 1850? She died on 4 May 1859 in Houston Co., GA, but wasn't listed in that county on the 1850 census. Her daughter Sarah Ann married in Houston Co., GA in 1843. Daughter Margaret married in Crawford Co., GA in 1844. Houston and Crawford border each other. Sarah may have been in that region with them at the time. Ruth Powers Hundley told me they moved first to Barbour Co., AL briefly, then to Pike Co., AL then to Stewart, Crawford and Houston Co., GA.

John and Sarah (Turner) Powers' children are named in the court records as Charles Powers, Margaret Moore, Sarah Ann Holly and Penelope Williams. Charles was in Stewart Co., GA in 1850 and Henry Co., AL in 1860 (if that is the correct Charles Powers).
